Texting Teen Falls Down Manhole
We all know that walking and texting is a tough combination -- but a Staten Island teen learned the hard way when she fell into an uncovered sewer manhole while trying to send a message.
Now, the family of Alexa Longueira, 15, intends to sue.
The girl suffered a fright and some scrapes on her arms back after she dropped into the hole on Victory Boulevard.

"It was four or five feet, it was very painful. I kind of crawled out and the DEP guys came running and helped me," Longueria told the Staten Island Advance.. "They were just, like, 'I'm sorry! I'm sorry!"
For its part, the Department of Environmental Protection said its workers had turned away briefly to grab some cones when the incident occurred.
"We regret that this happened and wish the young woman a speedy recovery," DEP spokeswoman Mercedes Padilla said in a statement. She added that crews were flushing a high-pressure sewer line at the time.
The girl was checked out at Staten Island University Hospital and released.
Sewer line workers are supposed to cut off pedestrian access to work sites or at least mark them with warning signs.
The family said they will file a lawsuit -- for what, though, is not immediately clear. Her mother, Kim Longueira, said it doesn't matter that her daughter was walking and texting, and also, the 'gross' factor that can't be ignored.
"Oh my God, it was putrid," she said. "One of her sneakers is still down there"
People texting instead of paying attention are shitheads. This was poetic justice.

you know the NYPD spends about 15 million year paying out law suits? if u add up all the law suits in nyc, the amount of money being spit out is retarded. what a waste on people like this.

Last year I saw on ABC that the trip and falls on sidewalk cases were paying more than 10 million a year alone
We seriously need a loser pays policy with civil lawsuits.
Not normally a Dr Phil fan... but good on him for calling that little snot arrogant and self absorbed.... That mom needs to take the keys instead of enabling her daughter. 4 months of driving, she trashed the suspension, clipped a pedestrian and pulled an 80 in a 55 - I would have been D E A D if I pulled that.
As for the parents of the kid who fell down the sewie hole... I'd give them a good slapping. Waste my (metaphoric) tax dollars filing a law suit because your kid's not smart enough to watch where they are going... not if I had my way.
ERs have reported a large increase in injuries related to texing while walking. Falling off curbs, walking into posts and shit like that... really people?

Had to have been in increase related to I-Pod use too. I nearly hit a skateboarder and a kid on a bike just last week because they were both in the "stupid zone"..wearing their I-pods and oblivious to thier surroundings. Seriously, just inches away from them after they come out of nowhere crossing the street! I would have been the one that got sued too because of their lack of common sense and judgement. >:(

The worst part for me is the way these frivolous lawsuits subvert the legal system by jamming the court dockets and taking time away from real cases and real lawsuits that should be going forward.

in the grand scheme of things 10 million or 15 million a year is not that much not when so many millions are being paid out in pensions and such for the various departments, why don't they just do as private corps and have 401k style retirementes and save tons of money, its what is bankrupting gm and all the other companies.
frivolous law suits are always going to be there, what is frivolous to one person is not to the next, and besides we always think something is frivolous if its not our case or our family member injured, once our family is injured suddenly nothing is frivoulous even if it is.

That's an easy fix - just click the LQ or LQ+ at the bottom right - that should resolve that issue for you.

It sometimes amazes me that some people make it to whatever age it is they are being that stupid. She is going to be one of those idiots that drives around texting all the time. I see it every day around here. And why do 10 year old kids need cell phones?

Often I wonder why the hell I need a cell phone.
The obvious convenience is great but I hate it when people feel I should be available to take a call 24/7 because of it.
I loathe cell phones. I have a prepaid "emergency only" phone that gets almost no use at all. My landline barely gets use either. If it wasn't for 911, the rare call from friends or ordering pizza, I don't think I'd use a phone at all.
This makes my disconnect w/ constant texters even greater.

Not sure if its just the people over there....or its the island itself. Everyone there is sightly retarded and lack common sense. It is, or rather was home to a major garbage dumping ground, Fresh Kills....that might have something to do with it.
