Title: Update: My Ticket(s)
Post by: He Man on July 23, 2009, 02:39:30 PM
Got the letter back from the TVB. My violation got changed... it went from improperly displaced license, to

"NO PLATE, DIRTY, INSEC" no idea what INSEC means, and DIRTY? GTFO.

also, they dont seem to have a letter for my "no license plate light" ticket. hearing is on 9/03/09 anyone know how to push the hearing date?

You can usually call and postpone the date. I went there once adn some people wait till they are called. If the cop is there they will postpone it. You can just pay I think its $40 as a sort of bond that you will come back.

You can postpone the first time by phone.  You are allowed three postponements.  They can (and will) ask for a bond equal to the ticket on the third.  If your original ticket doesn't match the ticket you received you should be in good shape.  I wouldn't go by the letter though.  Might pay to see the clerk and get a copy.  Every moto ticket like this fought, win or loose, if you have the time is a good thing to do.  Imagine the court back up if everyone plead not guilty ;D

+1 to what Howie said.

INSEC stands for "insect" so apparently your insect was dirty.

Your plate needs to be legible, if it's covered in dirt & can't be read then there's a problem.

On your ticket there is a specific section and possibly sub section of the traffic law you allegedly broke.  Look this up.  Compare this to the description of the violation.  Is there a discrepancy?  While you are busy looking this up, see if there is any on line help for fighting tickets.  The key to winning is to be calm and respectful.

on my ticket it cites 402(1)

which is

Quote§ 402. Distinctive number; form of number plates; trailers.  1. (a) No
person  shall  operate,  drive  or  park  a  motor vehicle on the public
highways of this state unless such  vehicle  shall  have  a  distinctive
number  assigned  to  it  by the commissioner and a set of number plates
issued by the commissioner with a number and other identification matter
if any,  corresponding  to  that  of  the  certificate  of  registration
conspicuously  displayed,  one  on the front and one on the rear of such
vehicle, each securely fastened so as to prevent the same from  swinging
and  placed,  whenever  reasonably possible, not higher than forty-eight
inches and not lower than  twelve  inches  from  the  ground;  provided,
however,  that  in any registration year for which only one number plate
is issued, such number plate shall constitute a set of number plates for
the time in which such use is authorized, shall be displayed on the rear
of the vehicle and none shall be displayed on its front, except in  case
of  a tractor, when such number plate shall be displayed on the front of
the vehicle and none shall be displayed on its rear.

And description/narrative written in my ticket verbatum

IMPROPER DISPLAY OF LICENSE PLATE - OBSRUCTED
