In short:
- she gets hit headon.
- suffers broken hip, $80 000 in medical bills.
- passenger of law-breaker is now suing HER for not doing enough to avoid the accident.

woohoo at least it's not in California.......this time. :P
This is one of those instances where I hope the judge finds her guilty... and fines her $1.
Edit: After reading the article, the lawyer ADMITS that he is trying to recover money anywhere he can to help pay for his client's medical bills. I DO NOT anticipate this suit getting a favorable settlement, but filing it is his job.
That's some messed up shit there. That's upsetting.

"The strange case of Bismark Dinius"
Basically, five people on a sailboat get run OVER by a local deputy sheriff in a speedboat. The guy who had the wheel of the sailboat(not the owner) gets charged with manslaughter.
Warning: Don't read this if you think justice is blind(or fair).

I say play by their rules. Find her "negligent" and fine her $1. She'll have paid her "debt to society" and they can't sue her again.

You're being too kind. The article just says "compensation" and says nothing about whether the compensation is for purely medical or whether this guy wants to pad his pockets. The kid's dad wants to wring as much money out of this as he can but doesn't want to sue family. I say the whole family needs to be shot. Allowing this kind of thing to happen lowers us all as species.
no it doesn't
it merely lowers the falily sueing
the system functions that way
it doesn't show a flaw in the system
only shows a flaw in those select few who choose to take advantage of it in this manner
as for you and I, we wouldn't use it in that fashion so we are just fine.
ok erkish maybe I'm wrong
I just read an article in the newspaper about an employee at Key Bank in Seattle who captured a bank robber...and got fired.
you are right
we are doomed

Wow, that makes my blood boil.
chalk up another fail for personal accountability.
ultimately, the kid will win the case... the woman will have to take out loans to pay the settlement... she will default on her loans and be forced to declare bankruptcy... and you and i will end up footing the bill for this kid's stupidity.
go team.

Since the kid's dad is the one behind the shotgun lawsuits, how about we hit HIM while drag racing?

with a lead pipe? :D
This will be interesting to see how this plays out since juries are usually stacked with lemmings.
