As I read it, the dispute isn't about whether extra weight is unhealthy or not. It's about whether the weight alone accounts for a disability. The guy says he was injured lifting a heavy bag at work. The medical examiner said that wasn't the issue but rather that the problems were all due to weight. I do think the guy is drawing an excessively direct line between losing his house and being denied worker's comp for his claimed on-the-job injury. Either way, there's no possibility of divining the "truth" from a website such as this.
As someone who's been involved with worker's comp cases for years, I have very little faith in that system, nor in the disability system. For example, I had a patient who was on a ventilator with Guillain-Barre Syndrome in a medically-induced coma who was denied disability until his family hired a lawyer and appealed. You can't get much more disabled than being ventilator-dependent and comatose. At the other extreme, I have a patient who somehow got disability (that pays more than I make as a full-time physician) yet has no physical or mental limitations that I can detect.
Every time I send in an affidavit that says that someone's problem is NOT caused by work I get a flurry of offers from various companies to do lucrative work as an "independent" medical examiner. That never happens when I send in an affidavit with an opinion that the problem WAS work-related. Accordingly, I only ever do this for people who are already my patients. I don't believe most examiners are functionally independent.
Does disability cover you for any injury or illness that happens
at work, or is is
because of the work? I have never worked at a place that has even had disabilty...

That is true. I guess my biggest gripe with this dude is that he is acknowledging his obesity as his reason for loosing his house but not doing anything about it. He has even gained weight.
Think about all of the money Nutri-System or Subway would throw this guy if he lost weight using their product and turned his life around...

Damn...$20.20/hour to throw bags. :o I was a baggage handler for 3 years during college (great job BTW)...and made no more than $6.75/hour (1993-1996)...even as a "Lead Line Agent"! We always laughed that they trusted guys making so little money to push around $20M planes, loaded with people, within a couple feet of each other. [laugh]
Seems his problem was caused by work, and they admit that, but by about 1 year afterwards he was fully healed. Any recurrence after that point was a result of his poor physical condition, not inherent in the job itself. Seems reasonable to me.
I'm surprised they couldn't just put him on light duty all the time. Someone was always on lavatory duty (emptying and re-filling the planes shitters) when I was doing baggage...and that person always pregnant doged about it. Seems he could have been the permanent Lav guy or something. ??? I was on lavs for ~6 weeks when I broke my ankle...it is freakin' easy work if you're not grossed out.
Anyway...my guess is he was kind of a slacker, or was a high maintenance employee, and this was the icing on the cake. Employers usually try to keep quality employees if at all possible. Either way...he should have considered a "career" change when he realized he'd always have to be on light duty.

Back on track, this really pisses me off. My back hurts everyday but I still go to work. Workers comp? If I break an arm then ill claim it but that's only because its hard to do my job with only one arm. He said he hasn't paid his mortgage since October 08. I'm suprised he has been in the house that long without paying for it. This guy needs to stop feeling bad for himself and get a job. Can't help those that don't help themselves. Feel bad for this guy? Not a chance.

Yep. My backs hurt most days from wearing 26 lbs of gear 13 hrs a day. My fault for not working out those muscles more. I slipped and slammed my knee into the pavement last year in a foot pursuit, got up, caught the guy (so bummed he "gave up") and blew it off. The next day I couldn't walk up the stairs in the back of the station. I didn't feel bad filing a claim and being off for three weeks for it to heal. I got hurt working.
This guy has an avenue..he can walk out. It's part of the mortgage contract and nothing wrong with it. His circumstances changed and he can't afford the home. Give the bank the keys and move.
