Title: missed traffic court day
Post by: ab on July 06, 2010, 06:02:10 PM
So anyone ever miss a court date for speeding?  I looked at the 7th and set my calendar and scheduled a PTO for tomorrow.  I look at it tonight, it was for today.  It's 11pm now, I called the police desk and they said that I need to call tomorrow and ask for continuance.  Eventhough she said call as they will not see you, I plan on going there in person tomorrow and hope I don't get stopped in between (yes, no speeding to get there)
Anyone go through this before ?  What happens ?  Is the warrant a permanent mark that will affect everything in future - job , credit etc ?
Any info is greatly appreciated.

I'll try to be as gentle with you as I can. You're basically make the beast with two backsed. Short of making a run for Mexico there is really no way that this will not end with you behind bars, servicing the needs of  the sociopathic dregs of our society.

In all seriousness, it should really be no big deal. Make up some believable story and they'll just give you another date. Worst case scenario you have to pay the ticket and it goes on your traffic record. I doubt that a warrant has been issued yet.  ;)

Dude, the first paragraph was pretty good.  You got me good for a sec.

I am thinking I will tell the truth and say I make the beast with two backsed up and thought the month on the ticket was the day.  That's really what I thought.

This is a major make the beast with two backs up for me!

(it's been tough long weekend - about 5 wrecks that i know with 1 being a fatality (RIP Sammy)

Yup, no worries there, I've missed them before. As long as you actually show that you're not trying to evade and that it was just a mistake, everything is gonna be alright.

A lot of missing a court date comes down to the Judge. Some Judges will be tolerant, others will not.

Also, do you have an attorney?

Never go to court without one...............

remember, court is a boys club: you pay to play.

(What county did you get the ticket in? If you say Madison.........then you might be make the beast with two backsed pretty good. That is where I got my 98 in a 65. The Judge there is a real piece of work and HATES speeders. I got lucky. I paid for a good attorney, got a 200$ fine and 4pts on my license considering I could have gotten reckless op. One more year and those points will drop off.)

not sure what state/county/etc you live in, but where I am, they issue a bench warrant which can be executed and you can more or less set your stay of execution by going to the court house and paying the fine as a "bail" deposit to set a new trial date...of course you want to do that as soon as possible before the court connects with the DMV and suspends your liscence for a "failure to appear". Keep all paperwork WITH you during the course of this process as a just in case to explain anything and everything in the event of an additional encounter with Johnny Q Law before it is all settled and done with.

^^^

forgot about that.

Yeah, there is mostly like a bench warrant for your arrest.

Definitely go to the courthouse and talk to the Clerk.

Thanks DoubleEagle.  This season has turned out to be way too rough.   I hope the family of Sammy are coping well.  I am going to the wake tomorrow.  I did not know him very well but was hanging with him and 2 other people Thursday night.  It is just weird 24 hours later, this happens.  Life is too weird sometimes.  RIP Sammy.

Cyrus Buelton - It is at Grandview.  Got it at riverside road around 3AM on a Thursday few weeks back doing 67 on a 45 zone (cop was cool as he said he took the lowest speed as I was doing more than that).  So I went to the municipality this morning.  The clerk was not there but I waited there for his call back after talking to the front desk.  He was cool about it after I gave my honest explanation and gave me a new court date and indicated he will mail it out.  As for a warrent, none has been issued.  Phew !  As for lawyer, I am not sure what case I have really for this one.  I may just have to take a licking on this one.  I was thinking to ask for change of venue as Columbus is more lenient (can plead 0 point most times). One ticket dropped off, another will drop off in Sept, so I will be back to six points after this I hope (depends what they give me I guess in few weeks).

Ah shit, you got it in Grandview.

Very good on them not issuing a bench warrant (they might not even do that for minor infractions) and being lenient on the court date. Just don't miss the second one!!!

Getting a lawyer will get you a better deal...........they usually have some sort of relationship with the Prosecutor's Office, so you can plead and probably get a fine and 2pts. I am not sure how you can escape the points as I thought in Ohio any sort of moving violation was an instant 2pts.

I guess you could take it on supervision of some sort and if you go xx amount of time without a ticket, it will never show. I did that in Indiana once. I had to be ticket free for 2 years.

Seems like you have been knocked with a few tickets if you have six points, so my guess is you can add 2 more for this one. They will see a pattern of speeding and not be so lenient on giving you a zero point deal.

sorry, but you're totally full of shit on this one.   Wait, you're related to an attorney...no that was an expert Doctor by blood and an expert shooter by marriage, thus the expertise in those fields.   I'm sure there's an attorney in there somewhere you can cite for your jibbersih on this one.

What defense attorney doesn't have a relationship of some sort with the prosecutors office? Around here, most of them used to be employed by them.

But it isn't worth arguing with you and I never said I was an expert shooter. I've admitted several times I am not that good.

Carry on with your gibberish as well.

you may want to try changing the court date again, hope the cops subpoena gets misrouted at some point. plus , most cops dont want to go to court for traffic tickets, so if the date keeps geting changed, he may just kiss off court- especially if it falls on his day off.

although, if it was a highway patrol officer YOURE SCREWEDDDDD

good luck
