Title: D.C. Drivers Rank high in curteous driving?
Post by: Slide Panda on October 15, 2010, 07:00:24 AM
According to a survey D.C. Metro is the 6th most courteous drivers in major US metro areas... i dunno what drugs those people doing the testing were using, but man. Even worse is that Baltimore was rated even better...

A report came out recently that stated that DC and B-more have the worst drivers:

I suppose they're considered courteous since they don't often flip you off around here. :)

Yeah, they just honk at every and anything instead!

That is ironic, but they're not rating the same criteria.  One was based on the likelihood and frequency of auto accidents of DC proper.  The other was a phone survey (who volunteered to call whom?) about general road rage in the whole DC metro area, which likely includes people commuting on smaller roads who don't get as frustrated as those on farther, longer, or more congested routes.

Obviously they didn't talk to the dump truck driver and the car driver who were both charged with attempt murder/ADW a few months back for trying to kill each other on 95... Truck driver was cited for using the truck as the weapon, car driver emptied a magazine from a handgun

I've done that before...when I was taking a new rifle home one day from Atlantic...never had more courtious drivers around me in Rockville...the guys in the shop were funny about finding me the best strap/rig for it to get it home when I showed up on the bike too....

wow that may be the ultimate way to finally get motorists to notice you and not tailgate all the time.

i guess a pistolgrip shotgun with the shells on top would work best for visual affect, but then again i guess something like an ak-47 with an empty magazine taped to the stock would probably work equally as well, since both weapons are mostly seen in Movies most people would recognize both easier than say an uzi.. ok maybe most people would recognize uzis just as well from all the late 90s movies  ;D

Is that gun legal?

It seems like a good idea.

It's legal in VA to "transport" any firearm (even machine guns if properly registered with state police). However, the state allows individual municipalities to set their own ordinances about carrying loaded shotguns or rifles. FWIW, the gun in the picture is a Mossberg and is manufactured without a butt. So it's not "sawed-off".

that is the point you woudn't load it, afterall i don't think many people think and see "ok its not loaded let me mess with him".

as far as "transporting" any firearm, I think most places in the DC Metro area, (state and local ordinances and laws I am talking here) it is illegal to do so in a loaded state. Most local laws here require ammunition to be in a seperate container from the weapon, whether in box or in magazine or loose or whathaveyou.

I remember going out to shoot at Blue Ridge Arsenal a long time ago and getting some looks from people on the beltway making my way around to VA. I had 2 pistol cases and 1 ammo can and a gear bag strapped to my Ventura rack. It was kinda obvious what everything was, and in MD it was like OMFG looks from drivers. In VA, it was more like "Oh, take note and just keep rolling"....BTW...at one point, as a general note from that trip, ear plugs and a helmet just aren't as good at noise suppression and comfort at the range while shooting in comparo to glasses and full ear muffs.

nope!

In VA it is 100% LEGAL to carry a rifle or shotgun on a sling on your back.  The law does not distinguish between a pistol and a rifle/shotgun regarding open carry.

You cannot carry it in YOUR HANDS.  This is "Brandishing" and will get you charged.

However, just because it's legal (to wear a longarm), doesn't mean you won't get stopped and get chatted with by the popo.

But yes, it's 100% legal to WEAR a loaded long arm in Virginia.

you may want to specifically cite the statute....I have never seen ANY statute that says it is legal to transport a firearm loaded...what you started out with, if it is quoting from somewhere, doesn't say "loaded" in it if it was a piece that you copied and pasted...

No statute bans it, just like no statute bans unlicensed open carry of a pistol.

The correct question is what statute bans it?

The state AG's ofc isn't aware of one, and va has preemption.

Izaak,

Does VA have the same problem that WI has of local LEOs and DAs arresting/charging open carriers with disturbing the peace since they can't stop open carriers for any other reason?

No due to an arrest and lawsuit several years ago.  If you open carry here you may get a question from a cop just to see if you're otherwise sane.  I've carried open wearing a suit and got barely a glance from le.

That being said, carrying a longarm on a sling would merit greater scrutiny.  I don't consider a stop and chat under those circumstances bad.  At the least, its an opp to reinforce that being armed is ok and legal.

i think if a  [leo] pulled me over for wearing a shotgun like that and it wasn't loaded that as long as its a civil conversation of what's up and such and i was just on my way from the store or to or from the range, etc , it wouldn't be a big deal at all to me.

in all likelihood as long as its only a stop for just asking why i'm there and such and no tickets or such then would probably be pretty cool  [leo] and actually have a good conversation about guns and such.

OK, here you go:

VA preemption statute:

http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+15.2-915 (http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+15.2-915)

Does not distinguish between handguns and longarms, only allows localities to enact restrictions on discharge of a weapon.

And to the VA legislature's credit, subsection C permits lawsuits against a locality violating the preemption to get attorney fees, damages, etc.

but that does not say anything about transporting loaded or unloaded...

but that does not say anything about transporting loaded or unloaded...

it also doesn't say anything about sticking a midget up your ass too.  [thumbsup]

but after digging around even more, I found that the state allows localities to set limitations provided they are posted and it also allows for individuals to carry regardless of local statutes if they have a reasonable belief that it's necessary for their personal safety.

http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+15.2-915.2 (http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+15.2-915.2)

Fairfax does not have a loaded longarm carry prohibition, but Loudon does.
http://www.dgif.virginia.gov/hunting/regulations/local-ordinances.pdf (http://www.dgif.virginia.gov/hunting/regulations/local-ordinances.pdf)

Pretty nifty chart.

Back to the OP, I have found that pretty much all DC/MD/VA drivers are lame.  DC drivers are just lazy.  MD drivers are stupid and aggressive and VA drivers are stupid and timid.  I am not sure why this works out that way.

the answer lies here

Quote
...ยง 15.2-915.2.  This section empowers the governing body of any county or city to, by ordinance, make it unlawful for any person to transport, possess or carry a loaded shotgun or loaded rifle in any vehicle on any public street, road, or highway within such locality. Any violation of such ordinance shall be punishable by a fine of not more than $100....

i didn't see that original post when i posted the link to the same statute, but that only allows the localities to have the law.  look at the DGIF chart I posted, most of them do not.  (items #22 and #54)

Funny how this thread started about the courtesy of drives in the DC area and degenerated into one about carrying weapons... :-\

Unless guns are a highly effective means of promoting courtesy among drivers [laugh]

a loaded gun pointed at someone's head point blank has always been known to promote in most, but not all, instances at the very least "courtesy" from the person that the gun is being pointed at. [laugh]
