On Sunday October 24th a friend of mine was involved in a head on collision with a car. He pulverized his T12 vertebrae and is paralyzed from his chest down. He would like me to sell his remaining motorcycle to help cover some of his medical expenses. I was thinking of raffling it off.
<admin> wonderfull idea with potentially tricky legal issues. If those get sorted somewhat and it's clear the DMF isn't involved at all the thread can stay. We're not hosting any interstate gaming.
Maximum 200 tickets sold. Auction will end on December 31st at 5:00pm PST. Drawing will be held at GP Motorcycles in San Diego, CA.
The bike has only 3987 miles. The VIN # is ZD4RKC01XAS000030. Each ticket will come with a tax deductible receipt from the Can't Keep Me Down foundation. 100% of the proceeds will be donated to Xavier Rigau for expenses not covered by insurance. Make checks payable to "Can't Keep Me Down" and mail to 3958 corte mar de brisa, san diego, ca 92130.

I am extremely sorry to hear about your friend. It's going to be tough physically, and especially tough psychologically.
In regard to the raffle:
what's the number of tickets being sold and what insurance do we have you will actually deliver the price to a winner?
Sorry to hear about your friend. Hoping for a speedy, complete recovery [beer]
As far as insurance, Silent Bob's name is good enough for me.

I am sorry for your friend and have no problem with the idea generally speaking and making a ticket purchase as a donation...but it would be better to also announce the number of tickets you are going to sell and/or when the cut-off is for the drawing....nothing against you SB...
I still need to work out the details. But I was thinking of selling 200 tickets, having the money sent to a paypal account, sending out a contract specifying the terms, and having a cutoff date after which the money would be returned if the minimum number of tickets weren't sold. I was thinking of storing the bike at our local dealer and having them handle the transaction.
If anyone has any suggestions or experience I would appreciate the feedback.
My friend is handling things very well and has accepted his condition way better than I would have. He has some serious grit. I wouldn't be suprised if he got back on the race track on a bike with some retractable landing gear some day.
Sorry to hear about your friend. :-\

Very sorry to hear about your friend.
As for the raffle, I vividly remember a member trying to sell his bike via a raffle/lottery awhile ago and someone brought up some legal issues. You might want to do a little more research on that before moving forward with it. I know your intention is good. Just don't want you to get into legal issues. :)
maybe Speeddog can offer some help in reaching out or perhaps if you know anyone at Pro-Italia from when they did that charity raffle of the 'Sedici....
Sorry to hear the news. Wishing him a speedy recovery and hopefully some mobility regained.
Count me in on that raffle to help your buddy out.
"Private Lotteries
Private lotteries that provide some type of profit or cash for the person running it are against the law in California, but certain private, non-profit, and charitable organizations can hold a charitable raffle as long as at least 90% of the amount raised goes directly either to the charity running the raffle, or on behalf of another eligible charity or organization. The state itself runs a lottery to raise funds for education based on The California State Lottery Act of 1984.

So it sounds like you might have to set up a nonprofit to do the raffle. That's not hard to do in TX. My fiancée and her best friend set one up not long ago to sell some t-shirts, and donated the proceeds to an animal shelter. Don't know how it works in CA.

From what I understand, you could set up the non-profit and donate the funds to a qualified charity. Since your injured friend is not a qualified charity it would not be legal to give him the proceeds.
Would you have to legally create a "fund" for your friend so he could become a valid recipient?

I've got precious little knowledge on raffles, and AFAIK the PI raffle was for a school.
and in reality that's not a bad idea to set something up for him, because it's long term recovery and this one raffle won't cover him in the future.

Setting up a non profit is unbelievably difficult compares to most organizations due to the possibility of fraud :(

I may be interested depending on what what the money situation is that week
I spoke with a friend of mine whose son was paralyzed in a surfing accident. She has a non-profit setup already. She said she would accept the funds for the raffle and cut a check to my friend. She would also provide me with the tax deductible receipts for those who purchase tickets.

Hush, you!
as long as you are doing this all legally and the raffle is legitimately done t
hen i think you will get an awesome turnout for 50-$100 per ticket and then if you sell something like 500-1000 of them that would at least cover some of the costs your friend desperately needs.
i would be interested if and when you get this all sorted out and ready to go, i'm sure you will at least get around 100 people from the board here if its well advertised.
This is awesome, If I can afford it when the time comes, count me in!

Correct - we raffled the D16RR to benefit a charter school. We were only allowed to recoup our actual costs - NO profits at all. Bike at cost, etc... no markup or anything like that. Not sure how it would work in this situation. There are lots of things to think about such as tax considerations for the money collected for the bike.
Ok, Here are the details.
We will sell 200 tickets for $100 each. So, your odds of winning are 1 in 200. I tried to get a couple of shippers to donate shipping in the continental US but I had no takers, so shipping will be the responsibility of the winner, unless the winner is in San Diego in which case I will provide free shipping. The bike will be on display at GP Motorcycles in San Diego. The drawing will be held on or before December 31st 2010. The drawing will be video taped and posted on youtube. If all 200 tickets are not sold by December 31st, participants will be offered a refund. The bike has only 3987 miles. The VIN # is ZD4RKC01XAS000030. I'm In. To purchase a ticket do we just send $100 to the paypal account and you will tally who sends it? Or is there something else we need to do? Also, I'm assuming that we send it as a gift/charity donation via paypal, yes? Also, if I were to win, I'm in Tucson, Az (like 6 hours away) can I just come pick it up, or meet you somewhere?

110 tickets sold so far. 90 chances left to win.
If all 200 tickets are not sold by December 31st, participants will be offered a refund.
wait im a little confused.... if all 200 tickets are not sold the bike will still be raffled off. Correct?
We needed to set an end date for people to be able to get their money back. If all the tickets are not sold by the 31st we will either raffle the bike for less than the 200 tickets or offer a refund to anyone that wants to opt out and continue the raffle for those that want to remain.
but wouldnt your odds be increased if all 200 weren't sold? why would anyone opt out because their probability of winning increased?
Quotebut wouldnt your odds be increased if all 200 weren't sold? why would anyone opt out because their probability of winning increased?
not if they extend the date and sell more than 200 tickets
If we extend the date we still wont go beyond 200 tickets.
thx for the clarification. All sounds very fair
how many tickets we at?
I'm trying to work ticket funds for myself. when is the deadline again?
Can I PayPal someone close, since a check from overseas will be impossible.
That someone can enter a check in my name (sort of)?
*SOLVED**
We are closing in on 140 tickets sold so far. Xavi has decided to end the auction on the 31st and not go any further. So if you want to get in time is running out and your odds of winning have gone up. Currently a 1 in 140 chance.
We are planning on holding the drawing at 5pm Dec 31st at GP Motorcycles in San Diego.

He is doing as well as can be expected. The bone grafts in his left arm have healed and he is able to put his full weight on it now. As a result he has made significant progress in his physical therapy. He has made a few trips from the facility to his home and is working on doing transfers to and from the car. The raffle money has gone a long way toward making his home ADA approved and soon he will be back there full time. I offered to strap him to my back and take him for a ride but he just thinks I am crazy. Someday he will change his mind (about the ride, not about me being crazy).
Thanks again for all your support. This place is great!!!
Glad to hear that he's making progress. He's very lucky to have you as a friend.
