Title: Gifts and Liens - now with revenge plots!

Last fall my stepson got divorced, after about year of marriage. Dated for years, but never lived together until The Big Day (huge mistake, IMO). Things unraveled rapidly from there. He moved out, things proceeded, The pregnant dog got the house and managed to miss a payment before he got his name disentangled from the loan so he's got a nice mark on his credit to boot. And no reach-around.

Back when they were in the midst of getting ready to buy the house, I gave them $4000 to help with the down payment. I had to sign a paper with the loaning bank to the effect that it was a gift, and not a loan that was meant to be paid back.

Since it's winter, I'm bored, and I can be a vindictive asshole when provoked and wouldn't mind $4K in my pocket to do a little remodeling in my own house before spring, I'm wondering if there's any way I could slap a lien on the place or some such. Or if I'm well and truly boned since I signed the gift statement.

Doesn't mean that you can't get some kind of revenge, just means that you can't go the $4000 gift-turns-into-loan route.  There is more than one way to skin a cat.   [evil]

But what kind of revenge.....

It would have been soooo fun to tag the place with a lien, even though I'd be willing to bet The pregnant dog loses the place anyway.

I don't want to physically hurt anyone, nor cause property damage, since I don't need to get myself in a bind (plus karma's a mean ass pregnant dog).

I'm thinking some sort of massive embarrassment/humiliation or similar.

Ideas? Suggestions?

Wait for her to default on the house... then buy it from the bank for cheap and give it to your son as a "The pregnant dog is gone" present

I doubt he'd even want the place, since her family lives a block away.  :P

Plus, as luck would have it, his job moved 20 miles so he's living within walking distance of work now, versus a shitty commute.

Not that I would ever do something like this, but a "friend" may have told me a story once...  ;)

Long ex-girlfriend story, but the gist was after "they" broke up, she ended up getting a new car.

Apparently, a couple of quarts of 20w-50 motor oil mysteriously found it's way into the gas tank of her brand new vehicle.

So, allegedly, the car started smoking badly whenever she would drive it.  So she took it back to the dealer. 

So, as the story goes, the dealer took the engine apart to check the valve seals/guides/whatever.  They found nothing wrong, put back together.  Still smoking, so dealer took it apart to look for something else. Nothing wrong again. 

Story ends with car eventually stopped smoking after a couple of tanks of gas, and she was very frustrated, confused, and very inconvenienced.   [evil]

Not that I would ever recommend something like this...   8)

YA KNOW....from a "having been through a divorce" POV, and having lost my HOME ( to distinguish it past being just a house) because of her and handed over to her in property settlement my 01 Monster 900 ( my 1st Ducati that I loved and bonded with) ...it is best to be done with her and cut the ties completely and move on...no sense in dwindling on it for him or on his behalf unless he has asked you for some help in expressing his pain in return back to her....

If one of the parties to the mortgage signed a document at some time in the past while still married which bound them to a sum and allowed the residence as collateral (albeit secondary to the primary mortgage) then you could put a lien on the house, but it would subordinate to the primary mortgage.

Did that happen?  A spouse signing for a spouse is binding when it comes to regular and normal stuff, such as home renovation, cleaning or purchase of items for joint use.

Nope, nothing like that ever happened. They barely had the place six months before everything went haywire marriage-wise, just the original mortgage.

Call me paranoid, but as things progressed I'm almost certain that The pregnant dog roped him into buying the place and planned on taking him for a ride. She had mentioned around the time of the split that she'd do everything she could to pay back the $4K.

Riiiiiiight.

Oh, believe me, if it wasn't several hours away I'd be all over that (several times a week). It is a classic....

Of course, that kind of distance would pretty much take the heat off me in theory. After all, who in their right mind would drive that far to do something so incredibly juvenile.  :D

This.

We've had 3 divorces in my family over the last few years, including my parents. Luckily, my parents split went as smooth as a divorce could possibly go. Their situation came to head, and they more or less decided to part ways. They did the paperwork and both moved on w/o any fighting or revenge tactics. The other divorced family members have gone thru all kinds of hurt and drama because they sought to avenge themselves, in several cases inadvertently causing pain to other family members not involved.

The only thing revenge accomplishes is to make one look immature and spiteful. It's never going to rectify the situation and just leaves you feeling dirty inside. It certainly feels good in the moment to get revenge, but it is going to achieve nothing other than making a horrible, shitty process even shittier.
