Title: I need a lawyer Post by: He Man on July 13, 2011, 03:05:34 PM for a 2 point ticket from an improper lane change.
Recommendations? Lets leave any talk of what happened or how it happened out of this forum. PM, or read my block for details. Title: Re: I need a lawyer Post by: Howie on July 13, 2011, 03:56:20 PM I read about the incident on your bog. Call me. If you don't still have my number send me an email or PM My regular lawyer is too expensive for a 2 pointer, particularly since there is no plea bargaining in NYC. Pakhan has someone who has saved his ass more than once.

Title: Re: I need a lawyer Post by: thought on July 13, 2011, 06:36:26 PM the last time i got a ticket, i showed up early and saw all these lawyers waiting at the door of the court. some of the taxi drivers there just walked up to them and asked how much to hire them. after seeing that, i just went up to a random one and paid him $150 and he took care of the rest. i think he basically just kept on pushing back the court date till the officer didnt show up and the ticket was dropped. in the end, he pushed it back about a year.
i really cant say if he's any good or not, but he did get me out of the ticket. if you want his info, i'll send it to you in a pm. Title: Re: I need a lawyer Post by: CDawg on July 14, 2011, 09:34:19 AM PM-ed
Title: Re: I need a lawyer Post by: tinger on August 17, 2011, 03:36:02 PM I got a 2 pointer in june for 'unsafe' lane change exiting 495 (2 exits from the lincoln tunnel)
Bumper to bumper traffic (all cars stopped).. How the hell is it unsafe when nothing is moving besides me? crossed a solid line no more than 5mph.. 1 of 4 bergen city cop pulled me over. Long story short.. to make the points go away (allow 2x in jersey) it would cost me $400! Lawyer advise me not to take this route as I should save it for a bad speeding ticket. 3rd postponement court date next week. Title: Re: I need a lawyer Post by: He Man on August 17, 2011, 08:24:39 PM save what for a bad speeding ticket? money? arent points the same either way?
the chance of me gettign a insane speeding ticket is slim to none. i find it difficult to speed more than 30mph in NY state. That is unless EVERYONE is speeding 30mph over. thats 85mph already! Title: Re: I need a lawyer Post by: He Man on August 18, 2011, 06:11:47 AM its still on your record, it just doenst get counted to your insurance premium. And if you dont pay it, every single time you get into jersey you risk getting your bike impounded.
Title: Re: I need a lawyer Post by: ducatiz on August 18, 2011, 06:55:53 AM None of my NJ tickets even showed up on my driver license..
Once I realized that, I'd just pay the speeding tickets and drive without care. Title: Re: I need a lawyer Post by: Veloce-Fino on August 18, 2011, 08:51:36 AM None of my NJ tickets even showed up on my driver license.. Once I realized that, I'd just pay the speeding tickets and drive without care. So you're telling me, when I ride in NJ during the summer and get a ticket with points I can plead guilty and take the points/pay fine and my record will never show the points?? (live in PA) Title: Re: I need a lawyer Post by: ducatiz on August 18, 2011, 09:36:38 AM So you're telling me, when I ride in NJ during the summer and get a ticket with points I can plead guilty and take the points/pay fine and my record will never show the points?? (live in PA) Call the PA DMV and ask them if they accept tickets and points from NJ. I had a license from another state at that time -- (neither NJ nor NY) and my state didn't even accept NJ's citations on my driving record. Title: Re: I need a lawyer Post by: He Man on August 18, 2011, 10:46:35 AM taht is news to me. LET THE SPEEDING BEGIN!!!
wait is it still a federal crime to be 30mph over? Title: Re: I need a lawyer Post by: ducatiz on August 18, 2011, 10:55:16 AM taht is news to me. LET THE SPEEDING BEGIN!!! wait is it still a federal crime to be 30mph over? there are no federal speeding laws except in national parks or federal property. but you need to double check with the NY dmv. I would be surprised if the NY DMV doesnt' accept NJ tickets, but most states outside of that area do NOT Title: Re: I need a lawyer Post by: He Man on August 18, 2011, 10:59:52 AM because 30+ over in NYC = jail time.
I was told that NY does not accept NJ tickets. this was by my insurance agent. of course im pretty sure they are lying scum bags anyway. Title: Re: I need a lawyer Post by: ducatiz on August 18, 2011, 11:02:07 AM because 30+ over in NYC = jail time. I was told that NY does not accept NJ tickets. this was by my insurance agent. of course im pretty sure they are lying scum bags anyway. you mean felony, not federal? 30 over in many places is a misdemeanor charge up to a year. people rarely go to jail for it, unless something else was going on. Title: Re: I need a lawyer Post by: Pakhan on August 18, 2011, 12:05:09 PM NY State does not accept points for violations from any other state unless it's a DUI. Oddly the exception for NY State allowing points to transfer is from Canada.
30+ in NJ is reckless driving and possibility of 1 year in jail. I didn't end up going to jail and no points but a lot of money. 30+ in NY is reckless driving and no mention of jail time from the judge, cop, lawyer or ticket. 0 points if you play your cards right but still a lot of money. Title: Re: I need a lawyer Post by: Airborne on August 18, 2011, 01:12:06 PM Plenty of friends who are from NY and get NJ speeding tickets...they pay the fine only and nothing else happens.
Unrelated, I got an improper passing ticket in jersey (4 F***ING POINTS) took it to court with a friend of mine who is a lawyer and plead to unsafe driving. No points. 450 bucks in fines. Title: Re: I need a lawyer Post by: He Man on August 18, 2011, 07:22:19 PM there is plea bargaining in NJ but not NY though right?
and yes i meant felony not federal. :P Title: Re: I need a lawyer Post by: cokey on August 18, 2011, 08:09:57 PM I know many people who have gotten big tickets down with no points.. city just cares about the money.. you usually pay double almost.. back in 04 when I first got the neon I got a nice speeding ticket in Jersey. Group of 30 all neons were headed to pa for meet.. I waited for the group at a reat stop on the tp but got passed.. they didn't tell me when they were passing. So in haste to catchup, I passed a cop at about 130.. he came up to me n said I saw all ya friends going 80 n you over a 100.. toldm why I was speeding. Hit me with a 90 in 65... 217$ recently while working got a bs ticket cause cop thought I made a right from the middle lane.. I wasn't, me and all the other cars doubling up on the right lane of w houston onto 6th. Dates for jan 31, I'm bringing a map layout n all.. think its a 2 pointer.. uhg.. think I need a lawyer?
Title: Re: I need a lawyer Post by: ducatiz on August 19, 2011, 04:36:18 AM there is plea bargaining in NJ but not NY though right? and yes i meant felony not federal. :P No idea. NJ is a revenue citation state. Around me, they don't care about the money at all, they just put you in jail for the weekend for speeding 25 over. No Questions Asked. recently while working got a bs ticket cause cop thought I made a right from the middle lane.. I wasn't, me and all the other cars doubling up on the right lane of w houston onto 6th. Dates for jan 31, I'm bringing a map layout n all.. think its a 2 pointer.. uhg.. think I need a lawyer? Lawyer can't hurt, but if you are arguing that it wasn't you, that's a hard one. Then again, try to restate the sentence " I wasn't, me and all the other cars doubling up on the right lane of w houston onto 6th" and I'll try to understand. If there was no turning from the middle lane and you were turning from the middle lane, then what? Title: Re: I need a lawyer Post by: cokey on August 19, 2011, 04:53:28 AM I was in the right lane as also the car to my right.. its a big lane and cars double up in it all the time..
Title: Re: I need a lawyer Post by: ducatiz on August 19, 2011, 04:58:19 AM I was in the right lane as also the car to my right.. its a big lane and cars double up in it all the time.. So there were two cars in the one lane? That's not legal. You will have a hard time arguing against that. Title: Re: I need a lawyer Post by: tinger on August 19, 2011, 05:39:47 AM save what for a bad speeding ticket? money? arent points the same either way? ] I was told by my lawyer that one is allow 'plea bargaining/get out of jail type card/reduce points' thingy twice in NJ. Not knowingly I used it once already 5 yrs ago pleading down a +12 mph over limit ticket so I have one left.. basically the lawyer advise me to save it for a rainy day. separate note.. a good friend (a corporate lawyer) suggest I get a NY license Title: Re: I need a lawyer Post by: cokey on August 19, 2011, 10:26:56 AM Yea I know.. actually 6 cars in same lane.. -sigh-
Title: Re: I need a lawyer Post by: He Man on February 19, 2012, 08:33:11 AM well this court date is almost here for this thursday and i just submitted a request to change the hearing date since i have class that day. There were no dates for me to select, so i jsut checked the "request alternate date" box and hope i get another day.
but if i dont, then my plan is to show up an hour early and find a lawyer there. I have to write down and get my facts straight and give it to the lawyer i assume, but the issue become i dont know what he wrote down in his book as to what i did, because as far as i remember, all i did was filter up between the sidewalk and a car. FIltering as in it was at a red light. Title: Re: I need a lawyer Post by: ducatiz on February 19, 2012, 08:48:06 AM Any kind of filtering is against the law in NYC
Were you perhaps pulling over at a sidewalk to check something on the bike? I.e. was it a necessary stop and you couldn't avoid pulling between the car and the sidewalk? Title: Re: I need a lawyer Post by: He Man on February 22, 2012, 10:19:13 PM so youre normally allowed 2 date changes. i clicked the wrong button ( accept and do not make any changes) and lost one of them. so i redid it and got a last minute approval to get the date changed to 8/30/12.
