The judge should be defrocked (or whatever they do to get them out of their robes and down to the curb) and disbarred for not offering an immediate summary dismissal of the suit

he should be working on real cases...this is not one of them...what a waste of tax dollars

The judge is probably still rolling around on the floor laughing his ass off...

I can see an smarmy attorney picking this up, but if it actually gets to trial...  Yeah, some judge ought to be disbarred.

hey, if a burgler can sue a homeowner for being trapped in their garage for several days, then why not a kidnapper on an oral contract?!?!...ain't the 'Murican legal system something else?....

This will see trial because his suit is a counter-claim response to the Rowleys, who are suing him for $75,000. But once it does go to trial, the judge is likely to give him a Picard-style face palm and tell him to STFU/GTFO.

Not that he has a legal leg to stand on. Illegal contracts are unenforceable. He just had to come up with something to keep from having a default judgement entered against him, so why not shoot for the moon?

You should read the case doc. It's linked right there in the article. Pretty entertaining. I bet the judge is having all his legal buddies come by to get a good belly-laugh.

The only reason why this case hasn't been thrown out yet is that there is money to be made by attorneys.

After reading this again, if I were one of the victims, I would claim that the assailant promised to pay $250,000, and that he renegged on his promise.

As stated in the article, the victims are suing him for $75,000 dollars for damages, emotional trauma, etc, which is what prompted him to counter-sue.

They could easily say that they did not know he was a fugitive at the time. The article said that the assailant claimed he was being chased by people who looked like police, but implied they were not police. I'm sure the lawyers are taking notes...
