I still feel that " INTENT " is the operable word here.

It's like the difference between murder and manslaughter.

With murder in the 1st degree , one 's INTENT was to commit murder.

Manslaughter , one had no INTENT to murder anyone but in the course of their actions someone died as a result.

What was this poster's INTENT ?
