drunk driver kills motorcyclist and gets 18 months????

WTF?  :'(


Circuit Judge Richard Perkins answered the question by sentencing Sarah Whitford, 27, to 18 months in prison, five years probation and payment of $7,777.48 in restitution to the widow of victim Valaile Fuaiva Jr.


Perkins noted that Whitford was convicted of a 2005 drunk driving charge in California in 2005 but said a pre-sentence study indicated she would respond well to a sentence that requires rehabilitation and restitution.

Why is it that the Judge was thinking about the well being of the person who committed the crime and not the VICTIM or his family?

Because as much as we want to claim "equality" in the USA we dont have it.  I see three bias problems in this story.  One the victim was of a minority race while the offender was not.  Two the offender was female and like it or not women tend to get lighter sentences for similar crimes as a man.  Three the victim was on a motorcycle and many times I have seen a lack of respect for motorcyclists.  It sucks that things are the way they are and people can flame if they like but nothing I have said is untrue.  There is no such thing as universal equality or justice in the real world.

P.S.
That judge should have to serve the time he didn't give to the woman.

I agree with NAKID. I ran a Texas State District Criminal Court forever. I was the Court Coordinator and worked for and answered to the State Dictrict Judge... and only him. Saw tons of intox manslaughter cases over those years and NAKID's spin on it is very true. Both of the Judges I worked for over those years would not have done that but I know for a fact that other courts and Judges would have leaned the same way as the Judge in the story. I had a definite influence on my Judges, in a common sense kind of way. Not that I am an attorney and I didn't sway their judgement from following the law but they trusted me enough to let me run their courts and trusted my opinion. They bounced many thoughts and ideas off of me regarding rulings and sentences. Obviously it was up to them. But I damn sure would have had a lot to say about that case!

I don't see that bias has anything to do with this ruling. It's not a sentence I agree with. To me, manslaughter (which is what this is) deserves more than 18 mos. But I'm sure that this is not the only ruling of this sort handed down.

Actually, he was Samoan, Tongan, Fijian or something like that but no matter. Still a minority here and even Hawaiians are a minority here. Maybe even more so. (Sad to say but true)

So then by your definition a black man in detroit is not a minority right?  The victim was of a minority ethnic group thereby making him a minority.

The way we enforce and punish crimes committed in or with vehicles should be overhauled.  The punishment for manslaughter (and simple drunk driving) is just too light, allowing the grossly negligent to get away with barely any time served (if any at all).  But every time they try to impose stricter or more harsh sentencing for dangerous behavior, we revolt (as Virginia's citizens did when they tried to implement harsher penalties for speeding).  Stiff sentencing and punishments do work (you should have driven Virginia's roads when 10 mph over = $1000; EVERYONE drove the posted limit in a State that had notoriously aggressive drivers), but we're just not interested in them.  We get what we want, for better or worse.

I wish I could find more information, but sounds like about the same thing as when my brother was killed.

He was coming from dinner at a friends house, drunk driver blows stop sign, hits and kills him.  I was only 10 at the time, so some of the details are IZ_.  I remember hearing she was a repeat offender (DUI) and only spent 16-18 months in jail.

One day I will find her and punch her in the nose.  Yeah, I hold a grudge.
I solve my problems like an adult, at the strip club drinking on a work night.
