so my 696 has leaked oil since i got it. Three times last summer i had to take it in and get it fixed.  engine case, stator you name it, they tried to fix it, now there is oil all over the side of my bike again, the fourth time! it seems to be coming from a bolt where the engine attaches to the trellis frame. I'm super pissed and didn't buy a ducati to have this type of shit happening.

What are my options? I feel like i got a lemon, i know its not, but to me it feels like it. I want to trade it in, but can't afford to lose my ass. What should I ask them for, I certainly don't want them "fixing it" again. I may try to press my luck and see if I can get a balls to the wall trade in and get a 796 without much of a loss.

sorry had to vent.

check the lemon laws for your state. some include motorcycles some don't. normally, if after a third repair on a new vehicle, the same problem persists, it's declared a lemon and you get a new one.

check the laws.

If the manufacturer fails to repair or correct a nonconformity after a reasonable number of attempts, the manufacturer shall, at the option of the purchaser, replace the motor vehicle with a comparable motor vehicle of equal value or accept return of the vehicle from the purchaser and refund to the purchaser the full purchase price, including all collateral charges, less a reasonable allowance for the purchaser's use of the vehicle not exceeding the per mile driven or 10% of the purchase price of the vehicle whichever is less. Refunds shall be made to the purchaser and lien holder, if any, as their interests may appear. A reasonable allowance for use shall be that amount directly attributable to use by the purchaser prior to his first report of the nonconformity to the manufacturer. In the event the consumer elects a refund, payment shall be made within 30 days of such election. A consumer shall not be entitled to a refund or replacement if the nonconformity does not substantially impair the use, value or safety of the vehicle or the nonconformity is the result of abuse, neglect or modification or alteration of the motor vehicle by the purchaser.

There's some form of lemon protection in every state, even if not explicitly written in a statute. We can go into more detail about non-conforming goods at Article 2 (Sales of Goods) under the UCC which is always an avenue to push for, as well as other contract law theories. You have legal recourse, but usually neither party is all that happy in the end (and these aren't high dollar transactions for the attorneys, so that's a bummer too). Rather than waste the court's time, i would suggest....

However, I would discuss this with your dealership, possibly another reputable dealership, and DNA. There are dealers who simply move inventory, and those that take care of their customers in a more holistic fashion. A guy that brings his 696 to AMS in Dallas got essentially an entirely rebuilt/blueprinted motor under warranty. Find one that will make it right for you, and drive the extra mile to support them.









Or jb-weld that s.o.b. and sell it to some squid on craigslist. BAZINGA!

Maybe there is excessive crankcase pressure?...

have them check the vent valve/system to make sure it is functioning and giving the pressure somewhere to go...

not sure if your 696 has the reed valve setup....

but too much positive crankcase pressure can make things messy in odd places

Get a second opinion from a different dealer and contact DNA.  The dealer either is missing something or trying to cover for something they FUBARed.  Both DNA and the other dealer would need to know the history of the bike.

good idea, the closest next dealer is detroit, 2 hours away, and to make things even more hectic, im moving to colorado in 3 weeks. Sounds like i'll need to get er done quick.

I would get DNA in the loop ASAP.  Let them know your situation with the move.  That way if it's not fixed by the time you get out here, they can assist.  

And if I'm not mistaken, you're moving to the Springs, right?
