I'm almost positive the one I have now is after market crap and springs back when you pick the bike up. The big problem is when I down shift it hits it slightly not enough to worry but does the stock or a better kick stand sit low so if I drop my pedal a little I wont hit?

More likely is you have the stock sidestand if it is self retracting.  Are you sure the shift lever isn't bent?  Also, make sure the sidestand is not loose.

a bent lever on the 99 makes this really easy to occur. really easy. even easier if you sport reverse shift.

I've got a spare sidestand and mount if you need it (cheap too). mine never auto-retracted though...

Weird. My 99 did not have such a thing. It does mount up differently than the 2000+ years though - the bracket is two bolts parallel to ground on case, not the ones at an angle.

I hate how it flips up. I keep thinking someone is going to get on my bike and drop it thinking the stand is down. I'm not sure if it's bend I will take a picture and show you guys later.

Any good non auto retracting stands?

My  '99 M750 doesn't auto retract, BUT it's got a very slightly bent shift lever and it hist the kickstand ~
