deposits are often nonrefundable, it covers his ass with regards to ebay fees (insertion/listing, etc) and time certainly is money.
sounds like the bike was ridden and the finish reflects that. bummer there were no high resolution pictures, but if you didn't ask for any before sending a $200 deposit, that's not something fair to complain about. If you did ask and he didn't have any, and you sent the payment anyways, that's the risk you take.

Why would he give you the deposit back? You should have looked at it before you bought it. It was a $200 lesson.

The fact that he has no high res pics is lame. Almost everyone has a digi camera capable of taking pictures large photos.
I've been burned by other's definitions of "like new" and "very clean" as well.
Right --
which is why I don't even bother unless they have good pix.
As a reference, these are the pictures I used when I sold my sprint:

I just checked out this listing. Looks like someone paid the 6500 for the bike.

Most deposits are non-refundable unless otherwise noted, however ethics and morals should play into this. If it were I, I would refund the $200 or try to get the sale finalized.

medal parts, faded, can barely read oil level bc the clear is faded, forks, odometer encasement, most medals are faded. i have seen enough 6 year old bikes to understand that wear happens. age is age. my 916 is 14 years old, with 25k on it, doesnt compare, and still has original paint on it and is in great condition. 01 r1100s, 44k, excellent, never repainted but cared for mechanically and cosmetically. even the medal doesnt show fade, both just stay inside when not ridden, and get cleaned after riding, and get a days worth of full cleaning, motors and all, every winter. not hard. besides that, my point is advertise correctly, dont mislead.

The stuff you listed could have probably been replaced for under $200..
the oil sight glass cloudy? $20.. metal parts ? like what? the levers? Buy a cheap replacement for around $50/pair.
i understand your frustration, but after you've bought 3-4 more bikes long distance you'll get a better idea. also, the comments about hi-res photos are gold. ALWAYS ask for hi-res close up photos. If they can't/won't/don't provide them, then walk on.
I've bought about 10 bikes long distance. Most from Wisconsin (
) for some reason, a lot of Cagiva and old Ducati owners there...

i buy and ride now, only to maintain a current good condition bike. My schedule no longer has time to buy bikes to recondition. i agree about some stuff, but when it comes to paint being faded, rear seat cowling faded to where it felt rough, paint on tank was more dark green than black from sunfade, forks faded out, all carbon fiber including the termi pipes were really faded and no clear left, it was more than a matter of just couple hundred to spruce it up. i would have taken it based on just minor stuff. but wanting 6300-6500 and telling me its worth that and being in current physical condition, it wasnt worth it. it had spent most of its life outside not covered, and weather, and most of all the sun tears down bikes bad, hell, i dont even leave my mower outside. I have 14 year old CF stuff on my bike that just finally started to look old. I can live with wear and tear, but i can also tell when someone plain doesnt care at all for physical conditions.

that year of bikes had bad paint. the engine paint was horrific on every S2R monster and 695. it was disgusting.
And any bike listed in the northeast unless explicitly listed as mint pristine condition is probably not. we get 4 seasons up here.
aside from that, ebay is ALWAYS buyer beware...ALWAYS.
aside from that, the bike looks great from the pics for an 06 monster. but theres no way in hell id pay that much. maybe 4500-5000 at most. but id have to really want that year of monsters.
