So I got dinged in my hometown (Allen) doing 31 over yesterday.  bang head

The question now is, what do I do? Defensive driving is out due to the amount over; as is deferred (that cuts off at at anything over 30!).

My driving record is clean and due to my age I assume the impact on my insurance would be minimal (right?). Should I just pay it and slow down or hire an attorney? Would that do any good?

Bummer.

Being the proud recipient of 2 Performance Awards last year:

Ask for "Deferred Adjudication" or something like that. You have to pay all the costs, but you keep your nose clean for 6 months- no more awards- & the Award is not part of your record  waytogo chug

Deferred is not allowed for 31 over; 30 over, yes, just not 31.

I thought about asking the judge to look past the 1mph and allow deferred. Any chance of sucess there?

Why not? You never get what you don't ask for.

Back in 1988 I got an 88 in a 55 on 455 heading east around Weston. Two nice DPS officers nailed me fair and square. I was lucky, back up the road they would have nailed me for 125+.

I didn't know about the excessive speeding rules so I booked my court date with the JP's office in Celina and brought along my copy of my spotless driving record. Well as fate would have it BOTH DPS officers showed up and they testified to having just calibrated their radar and how they both visually spoted me and commented on my speed before they lite me up. They testified that I was very polite and was already pulled over with helmet, license and insurance card in hand when they got to me. They even said I shook their hands and told them to have a nice safe day. laughingdp

The JP Judge then kindly explained to me that I was screwed and no, I couldn't take the driver safety course... clean MVR or not. But he said that since I seemed like a nice young man and was polite and courteous to the troopers he would find me guilty but would cut my fine in half! I thanked him and shook his hand and the troopers. They shared some good stories with me on the way out the door about all the asshole drivers and riders they have to chase then take shit from when they finally stop them. So they thanked me again for being a good sport. waytogo Dolph

Point is, they remembered me and actually spoke well of me to the Judge even though I was busted at 30+mph over. Their testimony saved me a good chunk of change! As well as the Judge being a good, fair guy.

Again, why not ask for the 1 mph to be over looked? popcorn bacon

Definately get an attorney.  They'll drag it out a year or so and sometimes the officers won't be around by the time your court date comes up.  It will come down to how leniant your judge is if nothing changes though.

I got nailed doing 120 down in Ennis about 10 years ago.  The troopers held me at gunpoint and cussed the hell out of me, so I think you got off easy.   Grin

Keep in mind that the ticket was issued in Allen so the attorney will have to be willing to go there.

The attorney's ad/link is geared toward DWIs but he has a HUGE traffic ticket practice. I've steered lots of family and friend's to John for years. Yeah, you will probably get a young associate to handle it... if they are even willing since it's not in Dallas County. John is a good guy and has a kick ass practice. Tell them you know Brian Bilbo who referred you and was the Court Coordinator of the 204th and 291st State District Criminal Courts at the Frank Crowley Court House in Dallas County. John knows me.

I have used these guys a handful of times.  If they can't handle it in a certain area, they should refer you to someone good that will.
