It may be Italian law but I sure don't like the sound of this. Corner/track workers and course marshals? Why? Because they had the "doctor" signs up side down? I don't like "dog piling" when it comes to tragedies. Hopefully for the sake of those that helped Shoya this will go away quickly.

I don't recall exactly how long it took for the legal wrangling to get sorted after Senna's crash, but IIRC it was 2 years or so.

Whatever your feeling on whether the legal deal is right or wrong, it's just how it is done in Italy.

The Amanda Knox case was murder.  "Manslaughter" in Italy has a greater range of actions on the part of the accused that qualify a person to be charged.

For instance, under Italian law, if a person has a duty to act on behalf of another (which the marshalls do) and do so negligently, it is criminal.  In the USA, this would be a civil case with the marshalls being sued by the family for wrongful death, but in Italy this is a criminal case.  They could go to jail for 5-7 years.

In American law, there are few instances where a person has a duty to act to assist another outside of contractual or familial relationships (i.e. the racer has contracted with the racetrack, thus the racetrack must act or a parent must act on behalf of their child).  But rarely are these criminal in nature when they come up.  European law is very different in these areas.
