This was at the Berkshire Mall in Lanesboro, Mass. less than an hour from me.
I'm specifically worried about the car being
driven by HER.
*edit* - this happened in Reading, Pa so I can feel a
little safer out there on the roads
maybe I should sue her for having to deal with the constant reminders of her stupidity.

It would be no more/less valid than whatever her and her lawyer have up their sleeve.
I say go for it. [thumbsup]
Idiot. Wish it were spikes in the fountain.
Isn't this a derby? Didn't I see this already on another thread? Not the ABC News story of it but the mall security video with the security guys laughing at her off screen. I even posted about her probably still texting as she drove away from the mall and how scary that is. Anyone else remember the thread??
I can't veiw the O.P.'s link due to filter at work but it sounds like the video I posted 2 days ago here..

She's suing for the embarrassment, not the safety of the fountain. But during the interview she tries to give an emotional story about how nobody helped her. What was she expecting? A life guard for the fountain? Even if the security guard saw her fall in on the camera, she probably ran away out of embarrassment before he got there. She says that one of her friends says that they saw her on youtube but I can't see how anyone could identify her from that vid. If she didn't say anything then nobody would have known it was her. All the embarrassment she's "suffering" from is made up. Nobody knew it was her and nobody was laughing specifically at her until she spoke up and declared that she was an idiot.

Exactly.
Plus...I don't think a person can expect privacy when in a public place. Meaning anyone can take a video of some dumb ass walking through the mall and post it on the web and there isn't anything the person can do about it since it's from a public place. Ducatiz? Spidey?
the only potential issue, as I can closely figure, would be the release of the security cam footage in the format/forum that is was done so in....not that she'd benefit from that...
I can see the mall cops getting fired/reprimanded. But, that's petty anyway.
And she CAN sue. The mall, security firm, or whomever she sues will likely settle as it's better than "bad press" or litigation.
That's the perpetual downward spiral that encourages more and more people to sue over dumb shit. If a company would just stand up and say "go ahead, sue - you got no case and you'll go broke trying," it might discourage the practice and cause the ambulance chasing lawyers to stop running with every nutball case.

No offense to the fine upstanding member of the legal profession, but if they made lawyers have some more skin the in game (besides their time) these types of lawsuits might be less common.
i.e. The lawyer gets 30% of any "winnings" but also has to pay 30% of any penalties.
Holy cow. I can't fathom the lack of personal responsibility that this person has.

Wasn't there an ancient Chinese law that says if you wrongly claim something against someone and it's proven to not be true/lie/made up etc. in court then whatever punishment may befall the accused would in turn now happen to you? As in if the punishment were dismemberment of a hand or limb and you lost in court then off goes your limb or hand. Am I just dreaming in colors or was there something like that? So if the mall, security, etc. says make the beast with two backs you and she sues them and looses can I push her in the fountain of piranhas?? Huh, can I please? Huh, can I? Can I??? Ah come on!! And the whole BS about no one coming to her aid and no one considered her feelings just make me want to [puke]. I'd give the security staff the day off and a round of drinks at happy hour! yeah. Shouldn't the mall fine her and make her pay to drain and clean the fountain? I'm sure there are signs that say "keep out."
And it would never make it to court. Which is a shame. Any company is just going to bend over to make it go away and we'll never hear about it.
I wonder if we can get reddit or 4chan to show her what real embarrassment is now that she's revealed her identity. I'm sure they could dig up an email and mailing address for everyone to plaster her obscenities. At least then her law suit would have some validity.

Let's blame the media [cheeky]
;)
I know the possible lawsuit isn't about the safety of the fountain but is about the release of the video. If she had just kept quiet, no one publicly would have known it was her. She got embarrassed so she contacted an attorney. Of course the attorney sees $$$$.
Now if it goes to court and she wins, the outcome will be all fountains will have to have "stupid people" fences around them.
I heard a rumor (of course I don't know if it's true or not) that a city in Europe actually pads the light posts on sidewalks because of idiots walking into them while texting.

i agreed until you brought the mcdonalds hot coffee case. That's a huge misconception - mcdonalds was, as a cost saving measure, storing/serving coffee at near boiling high temperatures so that it stayed "fresh" longer. They had been reprimanded numerous times, but refused to comply to what the industry standard "safe temp" was. The coffee served to the woman was so hot the cup was practically un-hold-able, it fell in her lap, and the spilt coffee gave her 3rd degree burns to the genitals.
hot coffee is hot. i've spilt hot coffee on myself. never gotten anything close to 3rd degree burns before.

Hate to point it out
no I don't, but the article you linked to states she intentionally placed the coffee cup between her legs so she could put creamer in it while sitting in a car. I can see how that is totally safe and not prone to accidents. [roll]
Personally, I've had 2nd degree burns from a coffee spill at work. I was walking down the hall and tried squeezing past a "hallway conference" and one person turned right when I was moving by which resulted in his coffee cup greeting my arm. I still have the burn scar and that was three years ago. By you're reasoning I should sue my employer for providing the coffee too hot. [roll]
In both cases it was the person's actions that caused/facilitated the accident. Hot liquids are hot, so um yeah, pay make the beast with two backsing attention to what you're doing dumbass!
The coffee is suppose to be a certain temp by law.
By Law, McDonalds is at fault.
But i'm not saying she isnt a make the beast with two backsing tard either. cause weather its 190degrees or 150degrees, its make the beast with two backsing hot and it stains. nuff said.
Now, if I were the mall, I'd hire life guards and put them on the fountain on each side and enforce it highly for the first month as a joke. Then make a commercial about it and air it, also as a joke.
Have some make the beast with two backsing humor, you SHOULD be embarassed that you did that.
you guys suck at reading comprehension. the jury found her partially at fault for putting it between her legs - 20% her liability for poor placement, and 80% to mcdonalds for absurdly hot coffee in spite of previous warnings and burns.

I read the whole, I just dont agree with it.
It should be more like 75% her fault and 25% McDonalds fault.
You do not need labels to tell you coffee is make the beast with two backsing hot. The cup was not so hot that you couldnt handle it, because if it was she would of never been able to hold it bring it to her lap etc. or it would of triggered some sort of common sense that the contents might be even make the beast with two backsing hotter.
They claimed that coffee at 160degrees burns you in 10 or so seconds. But she was in a car, she wouldnt of been able to remove her seat belt get out and take her pants off seeing how she was 60something years old. So regardless of how hot it was, it could of been 1,000 degrees, her actions was soley due to her own negligence. If it was 120degreees which wont burn you at all, she would of still spilled the coffee.
And who the make the beast with two backs opens anything between their laps?
well the great part is that you'll be able to cast your vote differently when its your turn on a jury
Except that attorneys always strike those with common sense from the jury pools as fast as they can, so only dumb shits or those that lie during the voir dire ever get to serve.
you've got a pretty jaded view of voir dire. people are people, each of them has a different life experience.
