So I going for a ride last night. [moto]
I am in the left lane of a road that has 2 lanes each way. Light traffic.
There is a car in front of me and to my right. It starts to slow down. As I am passing this car - she decides to make an emergency U-Turn. In front of me. I had nowhere to go as I was even with her rear quarter panel at the time.
The last thing I remember was hitting her car with the bike and flying through the air.
I wake up in the hospital as they are giving me an MRI. I am terrified.
I passed in and out of conciousness for about an hour.
Can I wiggle my toes. Yup. Sweet.
I remember the paramedic saying it was a good thing I had all my gear on. I agree.
I also remember the police officer saying the Lady had NO insurance.
This hurt almost as much as imagining what state my bike was in.
I got out of the hospital this morning. I escaped with a concussion and lots of bruising and sprains. My right leg got it pretty bad. I think I landed on my right shoulder and face.
In true fashion my streak of luck continues. This is by far the worst. I just want to ride. The bike is not as bad as I thought it would be. Its make the beast with two backsed don't get me wrong. Mirrors gone, side panel gone, fender gone, take chipped and scratched to shit. All levers are bent. It does start though. Oh and the forks are done also.
F T W
/End Vent >:(
ill try to post some pics in a bit. i'm going for a nap.
So glad you're ok! I'm sorry about the bike (make the beast with two backsing idiot lady). If theres anything you need, let us know.
*big hugs for SKOM*
Oh, man - good job on pulling through this one.
You made it. You win.
Don't sweat the bike.
Good luck and heal fast.
Another proper gear winning story. [thumbsup]
Heal fast.
Oh man, oh man..... Brother I feel for you, man you need to light some candles or burn some incense.... something to change your ju-ju. Take care of yourself and heal well.
I think you should buy a bubble and live in it for awhile.
Glad you are ok for the most part
Heal fast.
Totally blows. Great to hear you are O.K. Ive been there. Maybe not as bad, but I did spend 6 hours at the big H. Broken wrist and shoulder. 4 years later I still hurt at times. I am back on 2 wheels with a different approach. Now, I ride extremely defense. I assume that no one sees me and I put my bike where I have all the room possible for escape. Dont give up, get better. and get back on. I know I was a miserable SOB til I bought my S2R this year. I think it is in my blood. Oh yeah, do "not" let your insurance buy the bike. If you plan on riding again with a new bike you will most likely make a good buck selling old parts.
Oh man :( I thought the Bronx was the only place uninsured drivers made illegal U turns without looking. Is someone in that Canadian town practicing Voodoo on you? I thought you were moving. Work on healing up, worry about the bike and money later. Do contact a lawyer when you feel up to it. Insured or not she is financially liable, though it might be like getting blood out of a stone.
Heal fast, glad you're ok, this is why i have the MAX on my insurance on everything. Another +1 for wearing gear for the crash and not for show (t-shirt, shorts).
christ man, at least you are in one piece...
but I thought you were supposed to have good karma now man. make the beast with two backsing shit.
sue the shit out of her!
Oh and I have one stock lever you are more then welcome to have, I have CRG's now and only one is perfect. So if you want it I will mail it your way bro.

+1 Let 'er have it.
Glad to hear you're alive. That's really what matters, the bike can be rebuilt or replaced. You can't. This could have been soooo much worse.
Geez, lady had no insurance, seems like the real idiot drivers always have no insurance, suspended license, etc... They should crachdown on this shit somehow, the chich that rear ended me had a suspended license. A few years ago some jerkoff backed into my car with his, almost like he wanted to make it look like I rear ended him, of course he had no insurance. These people are make the beast with two backsing trash, this is unbelievable. [bang]
So glad you are okay at least.
Thanks for the good words. [beer]
I will be suing her of course. I suppose it could have been worse (although I am starting to sound like a bit of a broken record at this point). The pain has really set in now. Feels like I was beaten with a pipe. I just want to be out riding again ASAP.
I am moving on the 15th. Flying though LAX into Melbourne. I may just pick up cheap bike when I get there. I am finishing up at my current job and will be spending the last two weeks on ATV's in the woods. Not sure how that's going to go :-\
I have to stop by the police station tomorrow to write a statement. I'm having trouble rembering things about the accident. I'm not even sure what street I was on. Just the u-turn. I'll call my insurance company tomorrow and see what they can do for me.
[moto]
+1 to hear you were wearing the right gear
Heal quick
Good you are still in one piece...glad to hear.
Make sure your next president stands for health insurance for everyone.
Actually here in Europe its illegal to drive any kind of vehicle without an insurance that pays for your mistakes.
So if I run over a kid I have to pay for EVERYTHING needed to cure it...infinitely.
Thats the basic insurance here...the next step pays for damage on your own bike/car.
make the beast with two backs SKOM!
WTF are you doing!
Go and wrap yourself in cotton wool and sit on the couch and drink beer, you won't have medical benefits when you get here. :-\
Heal quick, your new country needs you. [thumbsup]
Glad to hear you came out in one piece....It seems like every time I get on this forum, there is another post about an innocent rider getting smashed by a cager who is paying zero attention and doing illegal ass shit. Makes my blood boil. Good luck with a speedy recovery, hope you get back out there soon!
Sorry to hear about this but you are alive and kicking. [drink] Heres to a quick recovery. Good luck down under and godspeed.
Sorry to hear, hope you heal up quickly.
Sorry to hear it SKOM have some [drink] and listen to The Day That Never Comes (New Met track) [evil].
I think the lyrics will make you feel better and they fit the situation. You can check it out and www.metallica.com
Have a speedy recovery [thumbsup]
Sorry to hear of this SKUM. Heal quickly and hope the lady gets what she deserves. [bacon] [bacon]
Yeah she definitely should pay for what she did to you and your bike. Try to get a lawyer. You might want to try to remember what street it was because if you write on the report that you don't know where the incident happened she might try to use that against you way later on. Most importantly don't take it for granted that you escaped. Sorry about your bike mine got messed up also a while back. Don't worry about it though. Just take your time and get the right parts and in no time you'll be back. Good luck.
Jebus, mang! How many mirrors did you break and when is the 7 years up?
Seriously, tho, glad to hear you're in one piece and mobile.
Don't forget to stop by her house on your way to the airport before you leave for OZ. Leave her a present (http://ducatimonsterforum.org/index.php?topic=9674.msg162131#msg162131).
And remember: bacon has medicinal properties.
Good luck on your healing man. Remember that even as the pain subsides, you may be with permanent injuries down the road that crop up later, and even mental problems like memory loss. My point is make it very much certain who was at fault for this in as much record keeping as possible.
Also I'd get a lawyer BEFORE you make the police statement, especially since you're having trouble remembering things. Don't want to leave any holes in there that her defense can poke at.
Sounds like this is going to be very problematic timing with your upcoming move, with regards to medical care and legal issues. Hope it all works out for you!! And I hope you can squeeze everything out of that lady as possible because she needs to learn to be responsible for herself and her actions, and respect the barreling death machine she is piloting.
Doh! Good luck on your recovery! Hope everything turns out well for you.
Aw crap! Terrible to hear, so *very* glad you're up and around, terrifying story.
Lawyer up and sign nothing. Take your meds and take it easy on yourself; let the insurance machine handle the headaches as much as you can.
Wishing you well: Heal heal heal!
ARGH!! D*mn SKOM!! Good to hear that you're alive to go on your new adventure. Wrote down EVERYTHING you remember NOW!! This may put a damper on your AUS plans..especially if you have to take this b*tch to court!! I spent the last 4 years dealing with insurance companies and lawyers. [roll] >:( [bang]
This sucks!! BTW..get ready for AUS Ducati prices!! Just warning you!! :-[ I'd get a Supermoto down there. Actually, if you do eventually get a Duc, the Melbourne area has a mechanic who does the work cheap!! [thumbsup]

Uh huh.. [roll]
I did my research! Better learn how to service it (any bike that is) yourself too!!
don't worry about the bike. think of yourself as a fighter pilot who had to eject over enemy territory. you made it out and soon enough there will be another f/a 18 waiting for you.
one more joins the club. :'(
the i've been there ron [evil]
Man, you-ve got the worst luck I-ve ever heard of. Pm me. I've got a brake lever and some side panels with your name on them.
Get well soon [thumbsup]

I will be suing her of course.
Do you have unisured motorist insurance on your policy.
If so, your company will pay for your bike and then go after you.
If you are going to go after her civilly for pain and suffering.........
how much do you expect to sure for considering the person doesn't even have auto insurance?
...get well soon! Folks ar right: you are the winner...you will be fine soon [thumbsup]
Sooo.
After being out of town for work for the past couple weeks I have determined the following.
- My insurance will not cover me for being struck by an uninsured motorist. [bang]
- I am on my own.
- Tylenol 3's are magnificent
I am in the process of getting a lawyer to handle things for me here in CAnada as I will be leaving for Australia next Monday. I don't give a shit about compensation for my injuries at this point. I just want my bike fixed.
I am really upset about not being able to ride. Not sure when I will get the chance to own another bike. Hopefully in a couple years. I am scared that I will forget how much fun it is. Accelerating out of a corner, flicking the bike left and right though my favorite twisties. [moto]
Thanks again for all the kind words. Please everybody make sure you are covered for shit like this (physically and financially).
Ride Safe.
WOW!
I'm amazed that you're not covered for an uninsured motorist. That's part of minimum legal coverage in VA.
Get a shark lawyer and sue her for everything she, her kids, and her grandkids will ever make in their entire miserable lives!
Sorry to hear, SKOM. I hope the lawyer can do something.

Dman that sucks. Amazing that your insurance will not cover your bills atleast!
nothing wrong with a second hand monster in Adelaide SKOM and then sell it when you leave (if you decide to leave!)
sorry to hear about your continuing bad luck.
[thumbsup]
Sorry to hear about the insurance, Skom. No justice. :-\
I only had basic liability coverage on the bike. My reasoning being that if I did something stupid to crash my bike then so be it. My fault.
However I didn't think about uninsured drivers. Won't make that mistake again. [bang]
Right now I'm seriously considering buying a frame in OZ then shipping down all the parts that still work. That way there is no vehicle import BS to deal with.
Best of luck SKOM. I hope that everything comes back together with little out of pocket from you.
I wish you an uneventful move (and this is NOT corrupt a wish!).
Enjoy OZ. So glad this isn't a local board, and we can keep up with friends when they move across the world!
Good luck on the reconstruction. Post pics.
[laugh] [clap]
My luck has definitely turned around. The cop dealing with my case is a little slow apparently.
I finally got a hold of her (the cop). I need to get the details of the woman who hit me. Turns out the lady who hit me does have insurance. She just didn't have her papers on her when she tried to end my life.
I might actually get some monies after all. Huzah [thumbsup]
Although it will still be a pain in the ass because I fly out for Australia on Monday morning. Looks like everything is coming up SKOM. I am so getting a new bike in Oz.
Glad you're OK [thumbsup]
If you're still headed to LA..................give me a call so I can hear the story firsthand over a [beer]
Heel fast [thumbsup]
That's great. [thumbsup]
I thought you were already here, i thought you flew in last Monday. :-\
The first warm day of Spring today, 27deg C. It might be a HOT Summer. ???
Wow. glad your okay and still able to ride. Sucks that stupid people drive stupidly. Ever get pics of the bike?
I know this is a very old thread. I'm reviving it anyway.
I am STILL in a battle with insurance. [bang]
It actually took me this long to get a hold of the lady's insurance company. Turns out that she is actuall denying doing anything wrong. She is claiming that she was actually in the left lane (there were 2 lanes in our direction of travel) and that she used her indicator to turn left. >:(
She also claims that I crossed the center line to pass her on the left. She in disputing the illegal u-turn ticket (court in march). I now have to wait until then to see if I can settle or if I have to sue the pregnant dog.
I try not to use the word hate too much. There are many people I dislike intensely. But I absolutey hate hate hate this girl.
Thanks DML for the space to vent. I haven't been on a bike since the accident in August and it's killing me.
[bacon]
ps. before anyone asks - I don't know of any witnesses as my brain was switched off for about 5 hours after impact.
What a hassle, but tell us how your are doing, your injuries.
Is your insurance waiting to see how this thing turns out in court?
You could try posting a notice on telephone poles near the accident, maybe someone witnessed it.

What a pregnant dog.
At least the girl that rear ended me told the cops she fell asleep and she told the judge the same thing. I can't believe the other person is trying to weasel out of this, man some day karma is going to put a big foot up her ass. I really hope things turn out well for you, these idiots on the road make me want to just forget riding next season.
A letter from a lawyer to your insurance company might speed things up. Insurance companies like to hold onto money for as long as possible.
So were in Canada do
you live, cause I never want to drive in the same town as this bad lady driver.
I hate people that do not take responsibility for their actions.
It sucks.
Sorry Bud.

This might be hard to do since SKOM lives in Adelaide now. If you remember..from the beginning of the thread..the accident happened in Canada right before he moved down to AUS.
and if I remember correctly, their seasons are opposite ours - so SKOM's in a warm wonderful climate for riding!!
How frustrating!! [bang]

Yes Very... You the roads here look like alot of fun.

I've tried getting a lawyer but it's been tough when I can't meet with them in person. Some good advice has been provided though. In light of these new developements, maybe it would be best for me to call around again.
The concussion is still bothering me. Every now and then I'll get a massive headache and dizzy spells etc... The shoulder is still a bit sore and I am pretty sure the accident all but finished off my right leg (read knee and ankle pain forever) That said I still consider myself lucky. Many people have had much worse injuries from far less severe accidents.
FWIW - I was in Edmonton at the time of the accident. Drivers there suck - hard. Although I am starting to to get the impression that this is the case in most cities.
Thanks again for the outlet. [thumbsup]
p.s. I hate liars.
