Interesting piece of NY legislation

I was looking at the new issue of American Motorcyclist and came across an article about an Assembly Bill that would allow bikes to go through red lights if the light is NG or our bike doesnt trip the sensor.  This was something that was discussed here a few weeks ago.  Although it makes sense to us, I find it hard to believe that we would be granted permission to go through a red light under our own discretion.  It leaves to much open for abuse of that privilege.

I believe MD has that law.
If you sit though 2 cycles you can run the red light.
There's a couple that I hit regularly that will never trip so I run it after 1 cycle

Still looking for the MD exception (which I believe is a myth) but here's what applies so far:

§ 21-201. Obedience to and required traffic control devices


   (a) Obedience required. --

   (1) Subject to the exceptions granted in this title to the driver of an emergency vehicle, the driver of any vehicle, unless otherwise directed by a police officer, shall obey the instructions of any traffic control device applicable to the vehicle and placed in accordance with the Maryland Vehicle Law.

   (2) The driver of a vehicle approaching an intersection controlled by a traffic control device may not drive across private property or leave the roadway for the purpose of avoiding the instructions of a traffic control device.

Kansas just passed a law allowing bikers to run reds if they don't change.

In SC you only have to wait 2 minutes:

(5) Notwithstanding any other provision of law, if a driver of a motorcycle or moped, or a bicycle rider, approaches an intersection that is controlled by a traffic-control device, the driver may proceed through the intersection on a steady red light only if the driver or rider, as the case may be:
(a) comes to a full and complete stop at the intersection for one hundred twenty seconds; and

(b) exercises due care as provided by law, otherwise treats the traffic-control device as a stop sign, and determines it is safe to proceed.

I think this is one of the most generous in the nation. SC also has no helmet law but strictly enforces the seatbelt law... Go figure.

Most states have a law on the books stating that if a traffic control device is not functioning correctly, then the intersection can be treated as if it has stop signs for all traffic facing a malfunctioning signal.  It could correctly be argued that a sensor which doesn't detect a legal vehicle such as a motorcycle is malfunctioning.

That said, it appears that you are correct about Maryland.  I can't find any statute which allows anyone to proceed through any nonfunctional traffic control signal except at the end of an exit ramp leading from an expressway to a highway.

We have that in NC.  There are 5 conditions to meet before you can go on red.

I agree, but when Johnny Gixxer blows through the red light on a bad judgment call and gets blasted, his family's first call isn't to the hospital or the morgue; its to their attorneys office.  And it's actions like this that warrant tighter restrictions and bullshit laws to cover the governments ass.  I worked in legal for a large municipality and you wouldn't believe how many rules and regulations came about because of legal issues.  

If people took responsibility for their own actions and acted responsibly we "probably" wouldn't have so many restrictions.  I'll be more than happy to give plenty of examples too.
