when you paying a bunch of money to put something together, it's not wrong expect things to be done right.
Mistakes are acceptable from favors but not paid work.
is the assumption that larger people tend to be upstairs?

I paid a shit ton of money for these doors and windows.

I have no idea why NFPA requires a larger opening on the second floor bedrooms.

...and have a high SHGC.

The windows in question were over 500 each.

.... so if there's any chance that continuing would risk you failing to gain a certificate of occupancy (or whatever the local equivalent is) at job's sign-off... then I'd be raising hell and having it done as required.  But if nobody is gonna notice, care or check.... and you're certain to get the final approval of completion documents.....  then....  it was a dwelling with legal compliance at the time of construction.... and should have no negative effect on future resale....

It is make the beast with two backsing annoying though when you go to the expense and effort to get it exactly right..... and somebody misses the point

That's my thinking. I don't think the point was missed. It was a mistake.

As I said...the windows delivered are the type I wanted at first. There was a quote with them floating around, and that's how the error occurred.

The windows required were actually less expensive, and IMO are a lower quality design that I don't care for from a mechanical aspect.

I can see how this would make sense to the bureaucrats, but I'm with you, I'd prefer the casement style.  If you disengage the crank mechanism from the window sash... then they open just as wide as a sliding window and so meet compliance  .

The window vendor is going to supply special hardware at no cost so the window will crank out wider. I believe the reason the window doesn't meet code is the glass area of each sash is minutely smaller thus making it more difficult for a firefighter to enter after busting the glass. I don't really know.

They are also making a financial concession on an additional fixed trapezoidal window I need.
