How can the punishment exceed the crime? She killed someone plain and simple. IMO she should be charged with negligent homicide.

i think a better way to put it would be a punishment that is fitting to the crime. jail time wont do anything in this case. its much better make her promote safe driving for 10 years. This way, she deals with the issue first hand everyday, and educates others on safe driving.

regardless, i hate to admit it, but people dont care about motorcycles if a family were killed on a bike though, maybe a slight outrage would occur. lets say a mom dad and a son riding together. but even then, people automactically assume, since we are on bikes we deserve it since we could of been in a car. the truth is, the car should of been paying attention.

Until there is public awareness the problem will not go away.  Motorcycle safety funding needs to go towards public awareness, not "safety checkpoints" where tickets are given for infractions like loud pipes.

RIP Anita.
That's F'd up.  >:(

I've been in situations where while stopped at a red light, drivers slam on their brakes at the last minute. SCREEEEECHH!!  Not a fun feeling. I make it a habit to leave my bike in gear with the clutch pulled and stay vigilant on my mirror, making sure I see the driver slow and come to a stop. Hopefully I'll avoid being hit by behind like Anita.

This is just total crap. This really should be tried as negligant homicide.

if you drive drunk and kill someone is it negligent homicide?

if it is then that is what she should get at the min.

its pathetic how many people do not realize that a car is a potentially lethal 3000 lb weapon that can kill or main many people in a fraction of a second, no different than shooting them with a 45 gun.

This is an example of such groteque negligence and disregard for her and others safety it's maddening! At the very least this woman should never be allowed behind the wheel again and probably jail for life would be appropriate because she needs to be removed from interacting with civalized society before she can have the opportunity to harm someone else. It would be good to sterilize her also so hopefully she can't breed any more stupid people.

Sad and angering.

Problem is, this happens way toooo often. Todays society breads these types of "crashes" (This was no accident). Many states are trying to establish no hand held cell phone activity. but that will not stop people from just not paying attention. Its all about me, who cares about everyone else. Until we start the "Eye for an eye" punishment system, there are not consequences for our actions. If you kill someone and "they" call it an accident, you pretty much just get a slap on the wrist. I pray that Anita is in a better place RIP and may the broad who slauthered her recieve the punishment she deserves.

I can't even type what I think about this sort of thing. Suffice it to say, I'm sad and angry.

Hi-ho-hi-ho....its off to the track I go.................

I wish the bike was a garbage truck or a pole--that's always the best lesson learned for a driver not paying attention.

Kind of like the girl I rode past the other day....READING A BOOK while she was driving.   [roll]

Reading books, putting on nail polish, putting on make-up, on their cell phone from the time they get in the driver seat to the time they get out of their vehicle, speeding with children in their vehicle.......and they(insurance companies) say women are safer drivers than men.

Nah, male police officers  are just more likely to give a ticket to a male driver, but let a female driver go which gives insurance companies and driver reports the false impression that men are worse drivers as there are more tickets given to men.
