FYI: The proposed noise ordinance bouncing around the NYC Council this year would permit the police to seize the bike on the spot if the exhaust did not comply with regs, or, in one version, had an aftermarket exhaust. This got my attention because, while I do not live in NYC, I do pass through from time to time and my '01 M900 was purchased used (through TOB, btw) with Termis already installed.
IMO, any type of noise regulation should be based on an actual measurement.

Agree with you completely on the actual measurement part of it. That should not be so subjective. This should prove to be interesting.

In Our little town, The ordinance is "certain noises unlawful" which was explained to Me as "any noise that offends another person within City limits"... Talk about a broad spectrum, I have been cited numerous times for loud pipes on My vehicles that arn't very loud, totally on the opinion of the officer. the modified equipment laws are just another tax to beat down Joe Citizen...No actual decible test, or emissions test, You're just wrong, now pay...OH YEAH, I should be in Albuquerque Thurs. the 8th on work trip, will have the evening to visit. I know I owe a couple people beers.....

Had a few Guys from work head to Vegas this Morn.on hwy 50 west, it was snowing on Monarch Pass, great fun on custom Harley choppers!!!
