According to the WFAA Daybreak copy that accompanied the story this morning, and the ABC Good Morning America interview with the rider, the driver was ticketed for the no DL/ no Proof of Ins and released at the scene.
He should lawfully have had his car impounded, but if that occurred, it wasn't reported in either news story. Inattentive driving might be hard to prove in a lawsuit. So unless he was witnessed speeding, tested DUI, or otherwise impaired or reckless, the fines for the DL/Ins moving violations are probably the only legal sanctions the guy will receive for nearly killing a brother.

Problem is I am sure the guy has nothing to go after. 100% of nothing is still nothing. There is a reason why some folks don't bother to have a license or any insurance. They have nothing and don't give a shit. 90%+ of the folks arrested for felonies and assigned to my state district criminal court had outstanding warrants for expired drivers license and no proof of insurance. It's a fact. What does that tell you about the person driving in the lane next to you?
