Multi-Ticket

Dumb question of the day: Riding home earlier tonight and had a guy blow by me in a JPOS and cut me off just before the camera that nailed me in my cage earlier this year. Lights start flashing, so I know the camera caught him. A few blocks later, I see the douche is stopped by the  [leo] [leo]. Do you get nailed by both tickets in a situation like that? Man, I hope so because this guy was 100% ass of a driver. I don't usually wish ill for people but this guy deserves everything he gets!

Obviously ducatiz is the expert, but I'd say yeah. And I'd doubt that if he got busted for speeding again 10 min later that the defense of 'I just got a ticket a couple minutes ago" would hold my water.

well...the key question is this...were they writing him up for the exact same red light infraction as he got flashed for...if so...then potentially, he could argue double jeopardy and pay the automated ticket and get that officer ticket thrown out on the grounds of having been charged and dealt with the same offense already....but I am just theorizing...

doesn't matter if he is being written up for the exact same offense that the automated system pegged him for....now..if they are writing him for something else...THAT is a whole differnt story...

even if they are writing him up for the same offense, he has to prove it was a separate instance.  even if it's only 3 minutes later, it's still a separate ticket.

proof is easy...officer has to cite exactly where the infraction took place, and the picture you get mailed from the automated system cites EXACTLY where it is with photographic proof...

Well running 1 red light and getting two tickets, one from a camera and one from an officer seems different to me than two speeding tickets. The single light is a fixed spot in the world and the instant to run it, it's a fixed moment in time. Doubled up tickets for that, would - in my brain, be double jeopardy.

But speeding that's a lot more amorphous. You're doing it over a large space and time. Enforcement of it occurs at a fixed point, that are (presumably) separated by space, therefore time and could be argued to be separate infractions. If I speed past a camera, slow to the limit, speed up and speed past an officer - it's two separate moments of speeding, but the end result of tickers would be the same as if I held a constant speed past the camera and officer.

Two tickets for one red light would chap my ass. Two speeding tickets that aren't at the exact same time... that's my stupid tax.
