The 796 has the exhaust valve in the midpipe and cats in the exhaust cans. US bikes and cars have to have a cat.
if you get the termi cans they have no cats (although i think the titanium ones do). but do get rid of the midpipe valve you'll have to get a 696 midpipe and a Motocreations Duc.EE to clear the ECU error.

All correct... and yes only the Titanium Termis come with cats.

Believe it or not, US exhaust emissions standards are for bikes are less strict than European standards and some Ducatis have come to the US without cats. Unfortunately, info from Ducati is sometimes less than accurate. If your 796 has a cat it is located in the front of the muffler. It looks like honeycomb.
From the Ducati website:
Emission Euro 3 (Europe version) - USA: follows the US Federal Regulation

well by the way the baffles appear, its unlikely, not without removing the baffles first, or getting at it from the front part of the muffler
also i would advise against doing that while on the bike, as debris could fall down to the bottom of the exhaust and potentially cause a huge restriction in flow
also... this is in my owners manual...

That's interesting. My '09 M1100s manual says the same thing.
"Exhaust system
Equipped with catalytic converter in compliance with Euro 3
emission regulations.
USA model: not catalyzed."
Of course it also says
"Transmission
Clutch:
wet multiplate;
operated by control lever on left handlebar."
I'm pretty sure I have a dry clutch!
