experience fighting a ticket?

Hey gang,

I am going to trial for a ticket I got last month that was completely BS (no really).

Anybody have experience being a thorn in the court's ass and winning?

My advise is to take whatever plea deal they give you and say "Thank you Sir!"  Seriously.

Here is a little story.  One of the guys in our local riding community was riding aggressively.  Someone called the police on him.  An officer pulled him over, but did not witness him riding aggressively. The officer wrote him an 8 point ticket.  When this guy went to court initially he was offered a 4 point reduction if he pleaded guilty, but this guy thought he could beat it.  Long story short, he ended up leaving court with a 12 point ticket instead (Im not sure how or why they added an additional 4 points, but he says they did).  He had to get a lawyer and it cost him a couple thousand  dollars to continue to fight it and get the ticket back to the original 4 points that they offered him in the beginning.

Yeah its hard....I wasnt speeding (no really).  So I am absolutely pissed off about it all.  The DA offered a one point decrease for a plea.  That infuriated me.

Trial is Sept 20.  I guess the worst case is 4pts rather than 3.  I will take some comfort in making the cop show up at least and being a thorn in his side.

but probably wont be a thorn! As far as i know, down here anyway, they get overtime to appear in court if its in there regular hours....

In California, there are a few things you can do to prolong your trial and decrease the chance of an officer showing up to your trial. Don't know if you can do it in the dust bowl, but it's called trial by written declaration. If the judge refuses to take your side, you then request a new trial but this time in person (trial de novo) and then have your date set. I think you are able to reschedule that one more time. The hope is that on each one of these appearances, the cop doesn't show and you get your ticket tossed. Its an unsavory tactic, but apparently it works in CA.

Just appearing in court can reduce points in half.  Worked for me and everyone else around me the day I had to go.  Apparently the 1/2 sale is/was status quo from what I'm told.

But I was guilty, no arguing that point.

If you're completely innocent, can provie it and have the resources (time, patience, money, attorney) and want to fight on principle, I would, without question, go for it.

P2, yeah in THIS case, i really wasnt speeding.  I was 3 hours early to a flight for my grand mother's funeral.   

Update...I got a letter in the mail from an attorney for the city saying a key witness to the prosecution wasnt going to be able to make it to the trail.  Cop?  Not sure.  If so, I will push to have it dismissed.
