Don't Don't Don't sell your bike. You will be sorry. First time offender with a clean record. Unless it's mandatory (and in Mass it might be) you wont lose your liscence for the whole year. You may qualify for a diversion program and if your a good boy for a year it's like it never happened.

one word of advice in selecting an attorney (from an attorney)

find someone through AA or a similar substance group.  you want someone who is a bit sympathetic to you, not just trying to get a deal.

this is your first offence?  most states have a diversion program for first offenders, but you'll have to jump through hoops to get it.  some places are harsher than others (i.e. NY). 

find a sympathetic attorney and figure out a deal you can offer the prosecutor.  they like slamming drunks, but you hit a curb, not a person.  plenty of people can't avoid doing that when they are cold sober.  you're not the posterboy for drunk driving enforcement.

i believe his point was more that with the limit at .08, it's stupidly easy to blow over with a beer or two (or three).

the rate at which you're affected by alcohol doesn't figure at all into your BAC.

Not to sidetrack this subject, but this brings up the perfect issue of drunk driving being a possible transportation issue.

People say take a cab, , have a sober driver, or get a motel (if you live too far from the bar, 30 or 60 miles where a cab will not service).  Sometimes especially for someone who does not make a good living, such as myself, a cab is too expensive( not in comparison to a dui charge though).

I have walked home from the bar instead of driving, the furthest was about 4 miles from home.
Also, one night I left the monster overnight in a parking lot  instead of riding it home drunk.  I got a ride from a sober driver.  The monster got trashed in the parking lot by some kids. 

My point is, some sort of discounted cab fair or other transport ought to be created to allow bars to receive business from drinkers while allowing the drinkers to get home safely and the others not drinking to use roadways safely.  Drunk driving is a problem in the U.S.  It's a transportation problem, not a drinking problem.

If it's a drinking problem then a solution would be to not serve alcohol at bars or restarants.
Or only serve those who are driving up to two beers, but you must take a breathalizer to make sure they haven't had any to drink before that.

Or install dui machines on every vehicle made to make sure no one is driving impaired. 

It seems their must be some solution to this problem, but lawmakers have not solved it and may not want to solve this issue.

Note:  I am not against alcohol in any way, with all the bright lawmakers out their a transportatiion solution can be plausible for this problem of drinking and driving.

If it's a drinking problem then bars will not stay in business.

This exists in some areas,  but it's usually associated with a private group and not a government entity.  However, you'd still have the issue with leaving your Duc at the bar while you get a ride.  I live in a relatively rural area now, and I feel like more people drink and drive around here because there aren't cabs.  I don't think there needs to be a discount cab company just for people who are too drunk to drive.  Factor the price of a cab into the expense of a night out drinking.  Can't afford a cab?  Then you can't afford to go out and get drunk.  Stay home, invite some friends over, viola no one needs a cab.

DUI convictions are large source of revenue for local municipalities and the state.

In Ohio you pay all your fines, etc.

Don't worry, the BMV gets their cut at the end when you get your license back.

Make that 1,500$ check payable to the Secretary of State.

Basically. I'm a well known local lush. I've been drinking too much to drive for years. Never once got behind that wheel. Always had a DD beforehand (typically I'd pay for a meal for them, and they'd drop me off and pick me up or some such). I'd agree that cabs are expensive. This is why we have friends.


Often Saturday mornings would find me hiking a few miles back to my car. Not so bad, really.


I have yet to go to a bar and not have a bartender be willing to ask if anyone was going my way, I shouldn't be on the road.


I did always hate that the places I lived in that actually had public transportation had it typically shut down at around midnight, when i needed a ride at 2.
If the state had not cut funding for the mental institutions, this project could never have happened.

You call up, someone shows up on a folding scooter or bicycle, throws it in your trunk, drives you home, then rides home.  That way you don't have the hassle of figuring out how to go back and get your car the next day.

Maybe I could do it as a side business on my folding bike when I am on my business trips... 8)

I can't see having a number you can call when you're drunk to have a hot chick in spandex/leather show up not being popular.

I went to grade school with a guy that started  this at Univ of Colorado Boulder back in the late 90's.


I like the concept, but aren't their limitations as to how far they will drive you home?

Not to mention the price, 20$ pick up + 3$ a mile??
