Has anyone gotten letters in the mail about debts that dont exist?
My dad keeps getting it from this one company. Its been 2 of them. I reported them to the BBB. Then he lets a letter today looking like its from the Kings County Civil Court.
THe letter it self has nothing execept saying that a summons has been entered into the system, you must appear in court. No date, not refrence number, nothing. Ontop of that, the letter was sent with Stamps.com printer, and the zipcode that appears on it, isnt even from Brooklyn. Its from Long Island.
So tomorrow i have to go to court to SHOW Them this letter of the impersonating them. So they can chase after them.
Im sick of getting letters from these guys, they even sent one that said
"Save 35% off your bill now! Tax Special! Pay only $3600 instead of the full debt!"
Its annoying as hell and ive read online that this company has scammed hundreds of thousands of dollars.

I get a copy of my credit report 2x per year. It is good to know what is on it.
It's pretty interesting to see what is on it. I have like 10 aliases on mine, which is pretty odd.
However, it hasn't made a difference as my FICA way higher than >750.

My first bank account in 1996 was with Bank One and continued with them til these day but now they are Chase.
We use the Chase Credit Card for everything due to the rewards and no annual fee. However, recently they are now offering a new Freedom Card with better rewards, so of course I switched to the new one as it is better for us.
On my old Freedom card they raised my credit limit to 30k a month!!! WTF!!! I could buy a make the beast with two backsing car on it.
But when I got this new one, they approved me for 15k, which was weird. So I made a comment to the banker about it and he was like "we can petition to get you a higher limit"
I was like "No thank dude, check my history, I've never even come close to maxing my card and my card is paid off the day the account cycles. I don't make the beast with two backs around with CC debit.
However, I love Best Buy. They give you like 36 months zero interest on purchases over 1000$. Of course I utilize this.
Buy a bunch of shit (which I could pay cash for but don't), but invest the that money in CD's, pay my stupid 15$ a month minimum payment, and then when my CD matures, I pay the balance off in its entirety. Sure, I get hit on taxes for a gain, but I leverage their money to earn 3% on my money. It is great. They somehow must have morons that rack up charges and not pay it off by the 36month time frame.
I am a finance guy and figured out what would happen if I didn't pay it off in 36 months. I was bored one day, so figured it out.
make the beast with two backs, they actually take the original charge, nail you at 27.99% from the origination of the purchase and add it to the car.
So you essentially are paying like 5x what you originally bought. It must work out for them for the morons that don't pay off their cards.
Sorry, no compassion on my end for credit card debit.
Back to your topic.........Have you placed a call to the Clerk of Courts to see if this is legitimate?

Send them a certified letter stating that you don't owe the debt, don't know what the debt is, demand proof that you owe the debt, and to stop contacting your and your family by any form of correspondence. By law they have to provide the evidence, so when they don't and keep sending letters sue the roof and doors off of the place.

Fair enough. Plan B, hire a PI to find out who owns the operation then pay a crack addict to kill the owner then kill the crack addict and PI. Can't be too careful these days you know.

i went to court today. They are INDEED sueing my dad for $2700 bucks in civil court. THey said its VERY VERY common and they get atleast 50 of these a day. And there are many more who just simply pay it or dont show up becaue they dont recieve teh summons as I did. Because people have not received their summons, they began sending out these letters that i thought was fake. It wasnt.
They said the letters are pre printed and have a standard format, they just put in your name and mail it to you with a 2"x6" strip that has your address.
Anyway, after talking to the clerk, they said you can either file a counterclaim, just answer it or just show up in court. I decided to counterclaim $5,000.00 reason: "Harassment, defamation ,lost of time from work and school, cost of litigation of this frivolous mater" (i told the clerk the situation, and they wrote that)
Because everytime they call (abut once a week) i ask for proof of debt they hang up.
So yea, I have to appear in court (well not ME, but since i am the one who has been harrassed on the phone) later in March.
By the way, the name of this company is Kirschenbaum & Phillips P.C., and their Arrow Financial Services is the one suing my dad.
As far as the summons goes, apparently there is a person called Ms. Lee who is a relative of my dad, Living in my building who wears no glasses and is of 5'5"-5'7" about 110lbs (there is none). So if i find this process server, id stick a boot in his ass. The process servers name is "HUSAM AL-ATRASH" yes ATRASH.

I JUST GOT HOME, posted this shit, and I get a phone call momments later from someone at "K&P"
Im going to try and up load the audio. THe guy from K&P claims that I (heman) is the person hes looking for(not me) and that hes is a professional and knows when someone is screening their calls. and that if i pass the message on, the person hes looking for MAY or MAY NOT know who he is, and that he would be DEEPLY offended if someone left a msg with more detail that a name and number at his house.
Awesome. Got the whole thing on audio with the guys name and number.
Should I call back pretending to be the person who hes looking for and voice record the whole thing and just start blasting questions at him so when i go to court I can prove how they are harassing me? Maybe i can get that $5000. Thats a whole year of free tution. :)

It appears that their MO is to represent shady debt collections agencies that buy up "old" debt. I had a similar experience with a company trying to collect on a T-Mobile bill they claimed I owed. I canceled my T-Mobile service, paid the early term fee and what there was of a bill. T-Mobile continued to bill me for 6 months claiming I never paid the fee which I showed them and eventually got them to back off. Well by then, it had been turned over to a collections agency. The issue was resolved with T-Mobile but the agency had never recieved notice.
I finally got it all straightened out and went on my way. 5 years later, I received a notice from a NY law firm stating they were collecting on this debt. After butting heads with them several times, I had a lawyer friend of mine draw up a cease and desist.
I mailed it to them certified mail with a receive receipt. Never heard another word from them and it never showed up on my credit.
i mailed them that cease and descease letter as well. they are required to give you proof of ownership of the debt within 30days.
But these guys are make the beast with two backsing RUTHLESS which is why I didnt want to just throw this in the trash.

I've had those letters and calls. I throw away the letters and tell the guy to pound sand on the phone. They don't call me or send me letters anymore. Then again I don't have anything cool to post on the board about my interesting life so you got me. [thumbsup]
Kui, look up the term "malicious prosecution.". I believe it is sufficient grounds in a small claims case in nyc. Bring in your paper trail etc and force them to appear and explain it.

ducatiz ill look it up. This case is in Civil Court though, not small claims if that matters.
EItherway, i have no problem getting out of this situation because there is no debt, ive called up Washington Mutual (now chase) regarding it, and they have no records and any mortgage my dad has with Washington mutual is in good standing.
But I'll look up malicious prosecution and use any tactic i can to piss all over them.

They sue with the hope that the person they are suing doesn't chase it or fight back. And once they win, a judgment goes a long ways towards wage garnishments, property liens, etc...

yup. because of that the city has started sending out letters telling people they should of been served recently.
not enough people complain so no laws are being passed to stopped this. said i should also report it to the FTC
