Surprisingly the tech acknowledged it's an overloaded system.   He said I will need to "escalate" my complaint.

I used to complain to my ISP about speed.

They out and out told me all they had to do according to the law was 80% of advertised speed.

Might be different there.

I don't know what the laws are here, but I'm sure if they average out the speed over a 24 hr period they are at 80%.  I just not usually up at 2AM
