slight aside...this has always bothered me...

if someone is doing somethign that i am going to actually hit them for it doens't matter if they are male or female. they are getting dropped.
and something does not include shooting off at the mouth. it would need to be them coming after me to do harm.

as to the DB in question cracking Lu, (don't get me wrong here Lu and matador) what's the difference between his random act of violence if it's against a male or female. we assume that because she's not a male she is inherently less adept at defending herself. from what they have said so far the punch came out of nowhere so matador would have most likely been dropped by that same punch and be in a similar situation with the jaw and whatnot.

i don't feel he deserves any more or less punishment because he hit a female. he desreves what he gets just for being a douchebucket who cna't think well enough to keep from resorting to a base animalistic urge of "HULK SMASH!" when confronted with something he doens't like.



i also grew up with 3 sisters who taught me early on not to underestimate women.

I think based on her injury you are probably right on felony assault.

I talked to my bro about it and he was a former prosecutor in IL and he would have charged felony assault due to pretty much what you are saying about the bodily injury.

Actually, I believe the police officer reccomends the charge and then it is reviewed by the Assistant State's Attorney who is assigned to the case in that court system. That is how it worked where my bro worked, not sure about your state or county law.



Re Knight - I agree with you. I don't believe the court system (at least it should not) prosecute differently based on sex of the individual involved. The law applies equally to all. If not, then that is racist sexist.

actually, yes, because that man would have been 1) expecting the possibility of another man punching him and 2) would have been able to defend himself. We can make all the bullshit arguments we want about men and women being the same but at the end of the day, we are NOT. Me, a woman, I am full of estrogen, I am genetically prepisitioned to carry fat and not muscle, so I can have babies, carry on the success of the entire human race, nurture, I carry fat in my boobs and my hips and not muscle in my arms. I am 5'3" and 130lbs, healthy and just what I am supposed to me. I got the the gym and lift weights like crazy so that I can be more capable than I was genetically predisposed to be - lift my bike, carry heavy things, etc. I am a hell of a lot stronger and harder than that vast majority of women. Still, I am in no way able to defend myself against a man, genetically predisposed to have muscle in his upper body, that is twice my size and has the testosterone induced adrenaline to exert force beyond his normal body mass means that I could never have even with steroids and other artificial enhancements.

your question rings exactly as though you had asked:
"would it have been different if he'd hit a man or a child?....or an old and frail person....or a cripple....or a sick person?"

would it?

people like you are the people in the system that I am afraid of dealing with. the people that I know are going to do their best to stop anyone from making this right because they don't see the inherent wrong or understand why a woman who grew up surrounded by good people would never ever think to defend herself from such a thing because the only men I've ever known, even in the midst of fighting violently with other men, would never ever dare hit a woman.
